Yup yup. In a civil case the driver may lose since there's a lower burden of proof (at least here in 'merica*). I always wish there was a way to get follow up & closure on some of the news articles that get posted here.

The sad thing is that in this as in many other cyclist/motorist interaction we'll probably never get the whole story of what really happened. Unless everything was caught on camera somewhere. Even then we still may not get the whole story as video can be edited. Or "accidentally" erased/deleted.
Yup. I've had my share of incidents in the short time I've been riding on the streets - including a dislocated shoulder last month from being forced into a curb. And a whole BUNCH of stuff yelled at me. I think we all feel that frustration.... but that doesnt mean we're always the one in the right. I wish the cyclist had been wearing a helmet camera, so we'd actually be able to see the incident.

Oh oh oh! I said "helmet"!!!!!!! Think we can get a good helmet debate going now? lol!

DC, why I keep all of my commute videos of particular incidents in a "raw" state, no editing involved

Ouch, I was once ran off of the street into an overturned wood and concrete bus stop bench. Thankfully I escaped injury. I was wearing my old black Army leather gloves at the time as well as a helmet. Surprisingly me and the bike were both unscathed. Not even a broken spoke.

It would be nice to see some footage of the incident.
