How to sell an electric bike for in NY state?

How to sell an electric bike for in NY state?

Hello, I am located Sullivan County NY and have a home made electric bike for sale for parts. It has a 750w brushless rear motor and a 36volt 20 mah battery pack on the kit (comes with charger). The rear wheel is pretty wobbly and keeps breaking spokes so I am selling it as is for someone who likes to fix them up. It's on a Janus frame with a nice suspension kit. Is this legal to sell on craigslist or ebay etc? How can I go about selling it? Thank you!

PS the bike runs perfectly other than the wobbly rear wheel and will do 20-25 mph easily. The motor is nearly silent. Also gets up steep hills very well

I am not a lawyer. For a proper interpretation of the law, speak to a lawyer.

With that said, I do not think your bike is legal for ON ROAD use. You can sell it on craigslist but you should inform the buyer (in the advertisement or when you speak to them) that the bike doesn't fit within the legal definition of an ebike in your location (Since you said its maximum power assisted speed is more than 20mph).

At that point, the buyer is responsible for complying with whatever laws apply to his or her situation (use it in another state, use it off-road only, add a 20mph speed limiting device, whatever)
