It's not new, it's a flash flag. They've been available for 10 years. Minus the idiotic scratchy bit, but with an actually useful reflective flag.

Maybe the scratchy thing is useful for people riding in areas with 25 MPH speed limits, but by the time anyone realizes that it is scratchy when passing me, they're already past.

Sure, but I've actually thought about implementing this myself.

In my version, I'd have two different color sharpies at the end of a pole. Get too close and your car gets marked (and we'll make sure that at least one of the two colors will show up...).
