Group Rides now Illegal in Hardin County

From a touring group, group rides are now required to have stupid high insurance rates in Hardin County Iowa. I used the headline from the interest group, just demonstrates deceptive reporting. Not illeagal, just required to be highly insured. Its still stupid though.

Instead of fixing their roads this is how government works today. Do they require motorists to have a million in liability insurance? Without the details of the Iowa Motor Code, I think that like most states the bicycle is treated as another car and doubt the Hardin code would stand up in court.

The Illinois Supreme Court ruled that cyclists are "permitted", not "intended" users of the roads therefore the owner of the road is not liable. TF

Hardin county has passed a law similar to this in the past that has not held up in court. This is an attempt to write a more robust law. If you can track back through online archives of Velo News, the legal reporter has tracked this sad story for quite a while.

In defense of Hardin county (a very limited defense that I don't believe in but place here so you get the other side), a death occured during a group ride a couple of years ago when a cyclist fell due to a crack in the road. The county was warned about the crack and posted a guard who went home after a while thinking his duty was over. The Widow sued, it was finally settled out of court for an undesclosed amount. The county's stand is that the crack would not have been noticable to an automobile and that they can't affoud to maintain the roads to bicycle 23mm tire standards. Therefor, extra insurance for organized rides.

The above is a loose recount of a couple of years of news as I understand , it may not be 101% accurate.

Assign separate groups of 10 riders. List them as group A, B and so on. Separate start times for each group. Problem solved.

As of today, the whole thing has been dropped. It did all come about because of a death on RAGBRAI and it got all blown out of proportion because of complete misunderstanding in the media and counties about a resulting lawsuit. You can go over to the A & S forum for a more complete discussion of it and also to www.bikeiowa.com. There has been all kinds of crap thrown around the state because of this thing all this year. I'm hoping it's finally over.

What they are talking about is RAGBRAI. That would require something like 1800 start times. - TF

Well it started with RAGBRAI, but because of typical knee-jerk reactions, it quickly became bicycle rides in general. As roccobike intimated with his MS150 reference, it would have affected all kinds of groups, including the local boy/girl scouts out for a ride together. Again, I'm hoping the whole thing will now die the death it deserves...that may not have been the best verbage considering how it started, but you get my point.
