Hmm Sorry. Not real sure about your State laws but when you get fired you are suppose to get your last pay check that day. Also, is your state an at-will employee state?? What this means is the employer and/or employee can fire or quit at anytime without an reason.

they have up to 30 days to issue all the money they owe you to you. Yes my state is an at will state, but I will be getting unemployment, even if I have to go to the appeal.

I think Tennessee is an "at will" state which means they can fire without cause. Some states allow for a 24 hour period that they have to give you your final check. That said, you could get a lawyer (try a free consult) and see if you have a case for wrongful firing. Obviously this is not a very professional manager but your problem will be proving any of these conversations because before it got to court the manager would be coached. Good luck though, sounds like being out of there might be a good thing in the long run. Get your resume out there and spend some time on your bike, it did wonders for me last year when I was in a similar situation.

Well I'm still sorry for that, it sucks to lose a job but that guy sounded like a jerk. I really hope you find something else. Now you have more time to ride.

Plus I get to go drink on this girls dollar tonight because I don't have to work in the morning...and yes merton, I spent every dime I got from that job on bike parts...time to put bike parts on hold for a bit It's all good though, he was a nutcase...I wanted out of the job anyways, and since I didn't lose my job through fault of my own, I'll get unemployment.

Sorry to hear this. I would definately take this up with corporate if you want this job. You don't state where you worked and certain corps. no matter which state, have a proceedure(sp) that must be followed. I was an asst. mgr. at a suncoast, and had numerous HR meetings. It was almost impossible to fire anybody. Again if you like this job and want to keep it, talk to your district manager and see what he/she says. Some will back their managers no matter what, others will do whats right.

Tough call there. Boss asks you at the last minute to work on a weekend when you've already made other plans in advance. How you respond probably depends on how much you want to keep the job. Most bosses will "remember" something like that, very few will just fly off the handle and fire you on the spot. I think this guy put you in a very awkward position through no fault of your own, and took a coward's way out when you called him on it. You've probably got some grounds for appeal if there is any kind of corporate body that reviews such things, but on the other hand, would you want to go back to work for this a-hole?

Hope things work out for the better.

well it's hard to know the exact context, TRD has provided a few paragraphs from his viewpoint of how things happened

boss sounds like a moron though, I would be proud of getting fired by him

Screw that guy. I'm assuming this was TGI Fridays or some similar restaraunt? You might think about getting out of the restaraunt business, as it seems to attract immature, mercenary *******s like this putz.

Sorry you got fired, but your first mistake was answering the phone! Geeze, when I was in fast-food I remember calling people to see if they'd come in on their day off and most times I knew I wouldn't get any answers but rings or an occaisional machine (way back when). I never let it ring very long as I knew that I didn't like to be called to come in on my days off either. . . and if I didn't get an answer (even though I only let it ring 4 times) I could legitimately tell my boss that I had called everyone I could, but no one answered!

This problem is why answering machines were made IMHO. My sister works as unit clerk in a local hospital and she says that most, if not all, of the nurses and clerks that she has contact with screen their calls with answering machines so they can avoid the dreaded "'saying no' to the boss" syndrome, unless they are on-call, which is a different thing.

And I'd recommend if you have to talk to someone asking you to come in to work is to never say why you cannot work, just say no, or a variation thereof; practice with a friend so you sound natural and not flustered. --But it's better to use an answering machine.

Since he called you on your cell, my response would have been that I was out of town and wouldn't be back until late Sunday night. Unless he has a GPS tracking device on you, he'd have no way of knowing you weren't telling the truth.

I got fired, and how I fixed it.

So I figured I had to do something to make up for getting fired, so I got drunk
