    Are my demands reasonable?

    Some of you may recall a month or so ago when I ordered a motherboard on eBay and it never arrived. Well, I made a mistake:
    3 weeks after the order was placed and I had filed a claim with paypal, the seller contacted me via telephone. He apologized, and explained why it happened. I can see why my item didn't ship, but there is really no good reason that it didn't. Not to mention the lack of communication. He offered the motherboard at a lower rate, in case I was still interested. I told him no thanks, as I had already purchased a motherboard from elsewhere (and received in two days). He asked if there was anything else he could offer me that is computer related. I told him I could use another stick of RAM. So, he offered me a 1GB stick of 400mhz RAM with heatsink for 40 dollars shipped. This seemed reasonable, so I took the offer and paid via paypal. We talked for a while about eBay, he seemed pretty nice, and he said I would have my RAM by the end of the week.

    A week went by, no RAM. I went on vacation for a week to come back and still not have RAM in my mailbox. I sent an email and he sounded surprised and said he would rush out a stick of RAM for me. The next day, I sent an email asking if he shipped it. No reply. The next day, I sent another email, no reply. So, I filed a claim with paypal. It's been one day, but no reply from him.

    Today however, something came in the mail. It was a rather large box for a stick of RAM. I look inside and what to do I find?
    MSI P4MAM- a motherboard. A low end motherboard at that, probably not even worth 40 dollars. I am pretty pissed. I want RAM, not a motherboard. So I am sending an email through paypal's resolution center saying the following:

    Hi. As indicated in my most recent email, you have sent the wrong item to me. I ordered a 1GB stick of 400mhz RAM and heatsink over 2 weeks ago from you, and was told I would have it by the end of the week. That never happened, so I emailed you 2 weeks after and you said you would rush RAM to me. Well, I got a motherboard from you, but no RAM. I didn't order this MSI motherboard, I want my RAM.
    I will ship this motherboard back to you if you desire.
    Within 24 hours I expect one of the following:
    A tracking number from USPS, UPS, etc. confirming that my RAM has been shipped.

    A full refund for the amount of 40 dollars.

    Either way, I also expect an email with direction as to what you would like me to do with this motherboard. Like I said, I will ship it back to you via USPS on Saturday, at your expense. I will also ask for 5 dollars to pay for my time and gas required to make the trip to the post office, that I should not have to make.

    Failure to meet these demands will leave me no choice but to escalate this claim and allow paypal to handle this.

    Are these reasonable demands?

    I would drop the $5 for time and gas. To me, that just sounds like you're trying to milk more money out of him.

    I'm glad I've never used ebay.

    Its a common scam. All he needs to stop your paypal claim is a tracking number going to your address. Doesn't matter whats in the box you will lose the paypal claim or only get a partial refund. It happened to me more then once.

    Keep what you have. File a paypal claim saying it was the wrong item and you want your money back. Try to get as much money out of him as you can and be happy with it. $40 isn't the worst that could have happened.

    Also file your claims quick and dont let him stall you. You only get 30 days to file the claim. If you are nice and wait 2 weeks for it. Contact him and he claims to have reshipped it and you wait another 2 weeks, realize hes lying and go to file a claim you can't. They try to stall you as much as they can by saying they'll ship something else so then you cant file a claim.

    alright, I removed the 5 dollar thing. I'll swing by the post office at some point when I head in that direction.
    I order from eBay constantly. In the 6 years I have used eBay, I have had just 4 issues. All but 1, my very first transaction, were resolved.
    I am tempted to just tell him to refund me, screw the RAM, I'll get it from elsewhere.

    Dont send back what you have.

    Dont deal with him anymore. He will just pretend to make things better long enough for you to give up or not have the ability to go through paypal. Just go straight to paypal.

    File a paypal claim now saying you got the wrong item and you want a full refund. He will have a chance to reply probably saying "No i sent the right thing hes scamming me.". Paypal will have to decide what to do and will probably just give you back some money or maybe all of it.

    Don't send back what you have. Just file the claim and hope paypal sides with you.

    If I'm reading everything correctly, I think you're being very reasonable.

    How did you pay? If you paid by credit card, and PayPal won't help you, you can still contact your credit card company for a chargeback. I've had to do it before.

    Well I sent the message. I added that if he chooses to send me RAM, I will not ship the motherboard back to him until I have the RAM in my hand, and have tested it.

    After around 20 days when he is still not helping go to paypal. He is most likely going to respond with...

    " I am very sorry for your troubles. I don't know how that got mixed up while shipping. For your troubles you can keep the motherboard and I will send out the correct RAM. Once again sorry for the delay."

    You are then happy. Realize in a week WTF! Contact him. He says anyday. You are nice and patient and wait again. You realize he is full of crap and go to file a claim and you cant.

    I am not sure how long it has been so far but from when you sent the money please keep track. I don't want to see you lose your money because you are to nice and forgiving.

    You have something like 30 days from the time of payment to file a claim. THat's why I said 24 hours, that way paypal will have it in their system with plenty of time left. I just want him to refund me now, and I will just buy it from another.

    He has 4 negatives mutually withdrawn and 4 neutrals. That doesnt affect his 100% positive from ebay but if you figure it out it is really only 98.1%. For 213 feedbacks that not horrbile but 4 negatives and 4 neutrals in that little of feedback is a bit high.

    Well some of the feedbacks are "Item was not new and didn't come with manual", but it says that pretty clearly in the auction. I don't hold that against. One guy had an issue, but got a refund quickly, so that's okay to me as well.

    Who called it?

    Im surprised he even went as far as he did. If you did cancel the claim you would not be able to reopen it and he would have definately had your money. Glad it worked out.

    Go ahead. Tell him you still want the ram. I think the thing you are missing is you will not get it no matter what he says.

    The only thing for you to watch out for with idiots like this is he can leave you a negative although you didnt do anything wrong. Just let him know you are fine with the outcome and if he wouldnt mind leaving you a positive. Don't leave him feedback untill you receive yours first. Its possible if you leave him a positive he may give you a negative and if you give him a negative first he will most likely return the favor. Another reason why some people dont have many negatives is because even if the seller does something wrong the buyer fears getting one from the seller as a "punishment."
