SAN FRANCISCO (MarketWatch) -- MarketWatch readers have given an overwhelming thumbs up to Steve Jobs, chief executive of Apple Inc., naming him the MarketWatch Readers' Choice CEO of the Year for 2007.<<

Yeah. Duh. The stock was $85 when I bought it in March. It closed @ $185 yesterday. It's $2 per share higher in pre-market trading. They'll blow the roof off Wall St. when they announce their quarterly results next month. Of course this does beg the question: what happens to Apple stock if Mr. Job's Gulfstream flies into a mountain? I don't want to contemplate that. Ooofaaaa. Can anyone recall a corporation this large and successful whose fate was more tied to one man's vision and leadership? I'm trying but I can't do it.

Apple Hit with iPhone Patent Lawsuit

They're getting hit with a few suits, according to the article:

The success of the iPhone has drawn numerous lawsuits. In California, Apple is facing a class action suit claiming Apple's exclusive deal with AT&T violates the state's antitrust laws. Apple also faces lawsuits involving the iPhone battery, which can't be replaced by users, forcing customers to ship the device to Apple for new installation

Hrm, so you can sue a company because you bought into the hysteria surrounding their latest overpriced, over-hyped shiny bauble and now you regret your poor decision as a consumer? Seems to me these things (network exclusivity and battery replacement complications) are what insurance companies refer to as "pre-existing conditions". Consumers knew about them, and now they realize they chose poorly: Instead of just owning up to their own idiocy, they're looking for a scapegoat and a handout.

Its cheaper to buy a different phone than buy an i-phone and file a lawsuit.

Newsflash 1: every hi-tech company is perpetually fending off patent lawsuits (I know something about this, I service patent lawyers in my business). Goes with the territory.

Newsflash 2: Last time I checked Apple had over TEN BILLION DOLLARS (considerably more than that) in CASH lying around.

They will survive. Even if any of these suits have merit. And most lawsuits like these do not.

If there is one thing Apple has, its attornies. I'm almost certain that there will be a settlement that is not disclosed, and the suit will be history.
