so my bike shop might be getting sued

i dont start working there till june but from what the story the kid told me goes like this. the guy bought a 2 bike rack(strap kind) and bought 4 bikes. We usually hook up the rack for free when bikes are bought the kid did just that(hes very good at it he has one himself). he figured he would put 2 bikes in the back and 2 in the rack well before the kid makes it into the shop he sees the guy straping all 4 bikes and before you could say "stop" the back window caves in and the gate gets banged up. the guy threw a hissy fit demanded he gets his money back, even after he damaged the bikes and rack and demanded he be paid on the spot for the window and damaged panel. the kid called the cops to get it sorted out and the guy grabbed everything stuffed it in his suv and left before the cops showed up they saw the security tape but couldnt make out the license plate or face. the kid is scared he might be fired he didnt know he was gonna do that my boss didnt seem upset over the phone but wants me to come by after work because theyre might be a chance he might retaliate.


so my question is does the SUV guy have a case?

I don't even understand the facts of what happened. Who is the kid? The employee or the buyer? He put 2 in the back and 2 on the rack or 4 on the rack and none in the back?? The weight of the bikes caused a window to break and something else to cave in??? Or he drove the car into something???

What I don't understand is two things:
1) How did the customer rack up 4 bikes on two-bike rack (without damaging any of the bikes) ?
2) How did 4 bikes "cave in" a saftey-glass rear window (without one of the bikes being a Harley) ?

I somehow managed to get the same idea that you did. And both questions 1 & 2 need clarification.

If the tape shows the customer putting two more bikes on the rack himself, then he likely has no leg to stand on, but he might sue anyway. The OPs post was kinda hard to understand.

yup cash about 800 worth. not just the bikes but money for the window and whatever damage done to the paint of the truck, he called the cops to prevent a physical fight. its beyond me as to why he took his **** and left the scene.

He has no case. I would never put the bikes on the rack. But only mount the rack. The customer should have read the instructions. I can see it on the people's court. The judge would ask, " so you bought a two bike rack, then thought that you could put all 4 on?

Another reason to have a policy to not put the bikes on is what if they fall off 50 miles later?

Look at the bolded words and read it as if you don't have any idea what happened (like your readers).

The pronouns (in this case, he) have no frame of reference, and I think you might be referring to two different people, unless the same person called the police, then left with his ****.

In the original, there may be at least 3 or 4 people referenced (owner, worker, buyer, cops???), with no information to help us understand who you are talking about. Remember, that we, the readers, don't know that one time when you say "he" it is referring to the worker, and then the next time you use "he" in the same sentence it refers to the buyer. With this issue, in addition to minimal punctuation and sentence structure, you will be fortunate to get a comment even remotely relevant to your situation.

1) Why does your future employer trust you more than his current employee?

2) What kinda job are you going to do at the bike shop that you have a more than 6 week lead time on starting?

3) Why is everyone (the "kid" and the owner) seeking your advice when you are newer than a noob.

4) Why would you want to work someplace where the owner is so insecure that he/she needs to turn to a newer than new noob?

I'm still trying to figure out what kind of vehicle is involved -- car, truck, or suv? I'm guessing it was an suv - broken glass and damaged [lift?]gate.

The glass probably broke because the hooks on the straps were attached to the glass(?). A no-no with all the rack models that we sell. If this is the case, the shop is liable because you sold the wrong rack.

1) ive been working there since 99 but the lack of insurance and 401k keeps me working elsewhere fulltime
2)3 bike trails,RR station,schools and usually next day turnaround on general repairs they need all the help they can get
3)read 1
4)read 3 follow directions
