I bet the dealer's first offer will be to just honor the price, and maybe try to fiddle with the financing to get his money back.

No, that door has closed. The dealership made a mistake on the price, they have to honor it. Having the guy arrested under false charges is WAY over the line. It will be cheaper for them to just give him the truck to drop the lawsuits.

When I bought my first road bike for $800, I went back the following day to pick it up. They accidentally gave me the "elite" version that retails for $1500 instead. They didn't notice for an entire week until I brought it back. I didn't even get a thank you.

“I owe Mr. Sawyer a big apology,” Ellmer said. “It is my plan to let him keep the $5,600 and to make Mr. Sawyer right. I can’t tell you how I plan to fix it, but it is my intention to make it right.”
Weasel words if I ever heard them. This from the man whose first attempt to make it right was to have the customer arrested on a felony charge. That's why I said, I bet the dealer's first offer will be to just honor the price, and maybe try to fiddle with the financing to get his money back. You don't think that a dealer like that wouldn't try to futz things back into his favor. He's not talking about a free truck. He's talking about honoring the price at best.

Mind you, I didn't say he'd get away with it. I agree with you, the probably easiest thing is to just give the buyer the truck. The bad publicity and a possible suit will both cost the dealership much more. What they did is reprehensible. If I were the customer, I wouldn't want to deal with them except through a lawyer.

Used to be fun buying a new car years ago.
This winter I'll be holding the Chevy salesmans nutz in channel locks while we negotiate a deal.

This dealership is just down the street from me. I actually took home a used Ford Escape from their lot a couple of weeks ago to show to my wife.
Too bad they didn't arrest me, I could use $2.2 million

Your wife should have you arrested and horse wipped for considering that POS.

I thought it was a cool story and sided with the guy until this at the end:

"Sawyer’s attorney told the newspaper that an apology is insufficient. Through two lawsuits, Sawyer is seeking $2.2 million in damages, in addition to attorney fees. The charges against Sawyer have been dropped, according to the Virginian-Pilot."

Now I just think the guy is a d1ck. $2.2M in damages? Come on. Another a-hole trying to take advantage of a minor injustice.

Minor injustice or getting bullied by someone with deeper pockets. How do we know that this is not some tactic they use on a frequent basis? They either screwed up or tried to screw the guy over and then filed a false police report and had the guy unjustly arrested and jailed. Not saying it is worth 2.2 million, but it is worth something to teach the dealership how to treat people. I imagine that if they would have done the right thing at the start, instead of the barrage of harrassing calls, etc. he might have a different attitude.

Well, I bet the lawyer is the one who set the amount. But I suspect it's like horse trading. They are naming a price they don't expect to get, but it lays out the playing field. Part of the damages are to scare that dealer and any other dealer into not arresting customers. The story is not over yet.

What do you think the chances of a customer getting their money back if the dealer "accidentally" charged the customer $5,600 too much? As long as they did not misrepresent the car sold, I would bet between slim and none.

$2.2M is simply ridiculous. Yes, the dealership is 100% at fault and should suffer some consequence (like giving the guy the truck for free). $2.2M just reeks of aggressive, sleezy lawyership.

Well, there's one dealership that will be changing its name or going out of business soon.

I would agree with you in principle here, unless it can be established that this sort of thing is common place at this dealership. If it is a one time occurrence, the amount is just stupid. Lawyer is probably an ambulance chaser trying to get paid.

How did the sales manager convince the police to arrest him?

That is what I want to know. Not only arrested but jailed! For what? Getting a great deal on a truck and having a signed contract to boot. It isn't like he found the truck in his driveway and did not return it. He had a contract. I would think he has a case against the police too. This whole thing smells of collusion between the dealership and the police.

Filed a false report I would guess. Did not give all the information. I do not see a problem here, as far as the police action goes. Could be more trouble for either the sales manager or dealership though.

Don't car dealers start high and bargain from there?
