Landlord Troubles
 
Lease ended back on Sept 2013. As per the lease, if I wanted to move out I had 30 days (the whole September) to make changes. Also, if landlord wanted to make changes this was the time to do it. Nobody made any changes.

At some point later, the complex was sold and new management company moved in. They immediately hiked $20 bucks. Not too bad, I'm OK with that. I asked for a copy of the new lease stating the new rent, which I need for other things... they waited a few weeks. Then they give me a letter asking me to fill out an application. Applications cost money, and can get denied... so I talk to them because, I already applied and paid an application fee when I moved in last year. They said it was OK then. Some weeks later, they send new letter asking for the application to be filled out.

Today, as I'm looking at this application, filling it out and such, another letter arrived saying they will no longer include energy in the rent. Can they do this? Then another letter came in, an energy bill, and they ask me to change the energy service to my name, which will require a deposit for sure.

Back in Florida there was a government office to deal with this, and this kind of things where highly regulated. I've been looking for a similar thing in Arkansas, but my google-foo is failing.

PS: And the energy bill says it's $80 bucks. How can it be $80 bucks??? I have no washing machine, no dryer, heating is gas, kitchen is gas... I'm not using AC... I only have a computer and a light-bulb. :\

Bottom line is some markets are heavily regulated, as far as rentals go, and some really aren't. My bet it Arkansas is the latter and as long as the charges they want to pass on to you are in the legal lease you're asked to sign, it's kosher. Generally, energy isn't included in rents with the exception of water, and even then unless you in a highly-regulated market like NYC, SF, etc., it doesn't have to be.

Generally, unless you've got no credit, utilities don't ask for deposits.

Arkansas has almost no protection for renters. That's why my landlord gets away with 2 months rent to break a lease plus a 1 month fee.

You can ask, but I don't remember any deposit for hooking up to Entergy for the power. The bill sounds rather high. My usual electric bill is 30, and this winter I've been using the heater a lot so it was 60 last month. I have no idea about how expensive gas is.

Since you are there, you shouldn't need an application. They should just pony up the new lease for your signature. You've already proven your ability to pay. Ask them for it. Go to the office and ask.

Yeah, that's the company, Entergy. I double check the bill to see if it was for more than one month but nope, it is for just one month. Doesn't make any sense.

House heating is gas.
Water Heater is gas.
Kitchen stove is gas.
I have no washer.
I have no dryer.
I haven't touch the AC since November.
Even the fridge is ultra small.

I'm gonna check this bill against other bills from fellow Arkansanites cuz this makes no sense.

Ok, bill says it's from 12/10 to 1/11 and the ammount of energy used was 844 kWh. Does that sounds right? 844 kWh for a computer and some light bulbs?

I checked PR homes prices not long ago. PR has this delayed reaction where, everything that happens in the US, hits the island months later. The whole housing bubble is just starting to collapse over there. But most livable houses are still on the 400k range. 200k if you don't mind crackheads occasionally walking the street, looking for car stereos to steal.

1. Application fee: You are already there. When the new guys took over, they had to agree to honor any leases in effect at the time. While you may have a month to month currently, that is still technically a lease with an unspecified term. So I think they should get stuffed on this matter.

2. The power bill: Find out if the units each have their own meters or if there is just one master meter for the entire building. If there are individual meters (unless newly installed due to the forced migration of excluding the power from the rent), then ask to see the itemized statement where you used that much power. If there is just one master meter, then that amount is representative of the average of the whole building and you will have a hard time proving you use less power than anyone else.

There are individual energy meters for every unit. Then where there since I moved in. I never paid any attention to it, since it was included on the lease. I wonder which one is mine... I could go and take a look.

Hum... checking... according to my super geeky application which gives me a historical data from the uninterrupted power supply unit, the rig is been using 250 watts on average, 24/7. Unless I'm doing the math really really wrong, 250 watts x 24h day x 30 days = 180000 wats per hour... divided by 1,000 to get the kilos, 180 kWh is the computah. Round it up to 200 kWh to account for any possible efficiency loss on the UPS. I still have 644 kWh unaccounted for...

Gonna calculate/estimate the light bulbs now... bbl

a 100 watt bulb ran 24 hours a day 31 day a month will cost ya around 8 bucks a bulb.now computer can range from 2 bucks a month to 70 bucks amonth if ran 24/7

My brief stint as a landlord taught me one thing: tenants who pay on time and don't trash your property are gold. Treating good tenants like that is stupid, and does not bode well for them being good landlords. Look elsewhere.

I only used 340 kW last month and I have a detached house with mostly gas appliances. My daughter keeps her computer on at all times and isn't great about turning off lights when she's not in the room. They're overcharging you.

$101 is about what we were paying in the southern summer with the AC on. This winter, we've really been blowing it out, though, and have had two $200+ bills. Everything in the house is electric, but we don't run any computers 24/7 except for the NAS which is asleep most of the time.

Do you have a copy of your lease that was in effect in September? Normally a new owner will be bound by the terms of the leases in effect at the time that ownership changed hands, but in some states it's allowed for the lease to specifically state that it ends upon the sale of the property. Check your lease for any language to that effect. Otherwise I would think you could contest any changes the new owner is trying to impose, including the minor rent increase and the utility charge since those were not in the old lease.

Dirty coils? maybe... gonna look into that.
Blower? yes, on auto tho, not 24/7.
Hot water also gas.

If the bill matches the meter, then the meter has more than just your circuits going through it. Here in NORTHERN Canada, where it's COLD, and we use power liberally ... the last 31 day billing period, we only used 513.93 kWh. We have a gas furnace, but the blower is an electric motor. Our stove is electric, and our two Jack Russells refuse to turn off the lights when they leave a room. Our usage would be much higher than yours.

They certainly can jump high enough and pushing a switch down is easy enough. Can you teach them that it's a cool trick to do, or at least convince them that they should never do it? Either of these ideas should have them turning off any switch in the house just because.
