New Blackburn, 1upUSA trainer; patent infringement?

I don't know how many out there use the 1upUSA indoor resistance trainer. I have had one for about 4 years and it's still great. I just saw the new Blackburn centrifugal resistance trainer with height adjustable legs, the design of which is obviously taken right off the 1upUSA model. Has anyone heard anything bout whether 1upUSA is planning to take issue with this, or did they sell their idea to Blackburn? I have no vested interest in either company, but I am curious. I hope this wouldn't signal the demise of a neat start-up company like 1upUSA.

Thanks, I had checked their website but didn't see that. I feel better knowing a small company wasn't ripped off.
