The bottom line is: Of course this could happen in the US. It probably would have been combined as a counter suit in the wrongful death case.

Now I'm curious about the details of the case. What really happened and what damage could the cyclist have done that caused $30,000 damage to the Audi? While the whole thing sounds goofy to me that doesn't mean that cyclist might not have been negligent enough to have caused the accident.

Not just any Audi, an Audi A8 with a $115,000 price tag. A new hood, bumper, and paint could easily run $30 large.

I heard he hit at 100mph, at that speed the damage probably includes the winshield, radiator, roof.....The driver could have been killed if the rider went through the windshield.

I dunno if it could happen in the US; depends on a lot of legal stuff I don't know. There are big differences, though. In Europe it's common for a driver to run down a dog, kill the dog, and then sue the dog owner for damages. Does that happen in the US?
