Road Cycling “It is by riding a bicycle that you learn the contours of a country best, since you have to sweat up the hills and coast down them. Thus you remember them as they actually are, while in a motor car only a high hill impresses you, and you have no such accurate remembrance of country you have driven through as you gain by riding a bicycle.” -- Ernest Hemingway

Not so sure I get it ... .144 BAC is almost twice the legal limit. Way outside of the analyzer error. If you did not drink at all that day, then you would want to get testimony affirming that and challenge the reading.

The law you quoted seems to describe a cyclist going straight while an oncoming motorist is turning left. It seems here you were turning left?

I actually read the original post he posted before he deleted it, something about him going over the hood, then the windshield, and the Ultegra cranks taking the brunt of the hit. I wasn't sure what his motive was for posting, and so didn't reply to it. Still don't know what to make of it. [Shrug]

I find it interesting that of all motorist/pedestrian collisions, about a third involve alcohol (over 0.08 g/dL)... by the pedestrian (those killed). In motorist/cyclist collisions, about 20% of the bicyclists killed have that blood-alcohol concentration. A combined motorist/cyclist BAC of 29% in all collisions, but unfortunately I can't find stats on if the drivers, or cyclists had the greater of the percentage.

Pedestrian & Bicycle Information Center - this site got their info from the NHTSA.

Moral of the story: If you're consuming alcohol, stay away from moving vehicles.

Are you saying you had nothing to drink yet tested positive for alcohol?

My guess is that with a pending lawsuit the OP must deny every aspect that casts their case in a negative light.

Yeah, anything in this thread could be used in court potentially. Not sure of the law on that but if it were me I wouldn't take the risk.

Hate to see a collision, even if one or both parties were drunk. Hate to see a collision even if no one really got hurt and nothing was damaged. Hope everyone involved recovers fully. Strongly suggest OP save the story until after the suits are resolved.
