Shipping horror...again

After getting burned by Fedex when I bought a bike, now the bike shop burns me in selling one. My question for the shop owners or employees; If a bike that you as a 'professional' shop packaged and it is damaged because you did not use one piece of padding or cardboard, what do you tell the guy who hired you for your services? I may be out over $150 for a new paint job because this shop in Vancouver WA was a bunch of morons. Anyone know how I go about tactfully getting some compensation from the shop?

1. Demand letter. Explain exactly your case. Which is, I suppose, straight negligence.

2. Demand letter 2 from your attorney.

3. File suit and have them served.

4. Go to trial

5. Get judgment.

6. Sell judgment to someone in their state.

Payment was by Debit card. Before resorting to legal means, it seems the bike shop would be concerned with their reputation; I would hope coughing up some money is better than legal fees.

I'm confused? You took a bike to an LBS to have it packed to ship it and it arrived damaged? They put it back in a standard bike shipping box? You know the same kind millions of bikes are shipped in every year.

What's so confusing? When bikes leave the factory, they're protected by, you know, that stuff that's called cardboard, axle protectors, and plastic wrap.

I say a well thought out letter to the manager and owner of the shop would be your first step. Be tactful but not too aggressive just yet. Save that for letter #2 from attorney if #1 doesn't work. Respectfully explain the situation and request that something be done. Then give them an example of what you'd like to have done to rectify the damage caused by their employees. ie - new paint job, replacement frame, etc...

And CC: the Better Business Bureau and any other outlets that could be helpful.

Fedex will deny the insurance claim if the package was not packed properly. A single-layer cardboard box with a layer of bubble wrap probably does not qualify.

Cross the bridge and have your bike shipped from a real bike shop in Portland! Veloce, CyclePath even an REI bike shop will take care of it for you and do a great job for little money and provide you with some peace of mind.

Communications in writing with specific problem, why it is the recipient's fault, and a demand for something specific. Search on "demand letter." Can be painfully polite. That's the way I like to write them.

I have recived many bikes and plastic wrap was never part of the equation. Hub protectors yes. So I am only trying to see how shipping a bike in a manufacture bike box has created a problem. The only thing I can think of is a puny bike shipped in a giant box.

Maybe it was part of another post but the story is incomplete as far as I can tell.

Or maybe the bike was shipped in a bag with no padding like lots of the stuff I have bought off scambay.

Millions of bikes are shipped individually by Fedex? Or are they shipped in groups, strapped to wooden palettes?

I have never seen them on pallets but that is not to say that some very large LBS have them shipped that way. Good question.

I've been to my LBS when it has received bikes, the ones it gets come right off the truck in the individual boxes. Although, I'm sure shipping from overseas, they're put on a pallet, not necessarily from the warehouse to the shop.

The bicycle was placed in a Trek Adult Men's cardboard bicycle box. This shop tends to sell a lot of BMX bikes; they may have shipped it in a smaller box than what is called for a Road bike. I plan on taking the damage pictures and taking them to the bike shop.

Alright now we are getting somewhere. The box was a standard bicycle shipping box of the correct size for the bike shipped? And we assume the LBS repacked the bike in the same manner as a mfg. would.

Now having run the transportion for a major chemical company at one time, here is the legal question. Did you contract the shipping or did you do it thru the LBS? It goes back to how a claim for damage is handled and I am not going to try to give any advice without that info. It would just be too long.

We used to ship drums of oil additives to Japan via container ships and if a drum had some paint scratched off the S^B's would file a damage claim and send them back at our expense.

Post some pix of the damage. Also a pix of the bike before it was shipped would be nice.
