Packin' heat on 2 wheels - legal?

Is it legal to have a weapon while riding a bike?

The reason I ask, is that my brother (perhaps the most hard-core commuter EVER) enjoys hunting, and there is a hunting ground only several miles from his house.

The protocol goes as follows: load messenger bag with camo, ammo, and hunting handgun (in a locked case, of course!). Proceed to hunting area. Be one with nature, and terminate the life of several small animals for nourishment. Proceed home and cook the quarry.

Someone I knew assured me that this was highly illegal, but I don't think it is. First, a gun can be transported freely as long as it is cased and unloaded. Two, he is not wearing a holstered gun while riding.

What do you think?

On a side note -
I do wonder how drivers would treat cyclists if they knew we were "strapped....." ?!?

most likely depends on your state. A&S would probably have a more definitive answer.

i've seen hunters in WA rolling on two wheels (with a trailer to pull out their kills too), so here i assume it's legal.

This totally depends on what state your brother lives in. As long as he is following appropriate protocol for transportation of firearms, he should be in the clear. However depending on the state, there could be some grey area you should check up on (like in ohio until recently was illegal to transport any sort of handgun in a vehicle due to mis-wording of the law). It may also be legal for your brother to transport his gun in plain sight in a holster (open carry) or if he goes through appropriate training and certification, concealed carry.

If you have a pistol in your bag, then I wouldn't stress. I've carried my .25 Glock on a ride before...it's not a regular occurence though...

I used to ride my motorcycle to the farm to hunt and had my .30-06 strapped to my back. Never got so much as honked at by a cager. I did get a bit harassed by an upset State Trooper though. After I showed him all of my info and told him where I was going, he let me go.

If you are carrying a pistol, you need a concealed weapons permit. If it is a hunting rifle or shotgun, just a hunting license, but the gun has to be in plain view. This is for South Carolina, but you can't have a felony conviction and carry a gun.

A cased, locked, unloaded gun in a bag that you're transporting to a place where you are planning to hunt should be perfectly legal regardless of whether you're on foot, bicycle, car, or motorcycle, especially if the ammo is in a different bag from the gun. But check the actual language in the legal code in the state in which you reside.

I would further suggest that BF is a bad place to seek advice like this. Your favorite local gun shop should be well versed on the legalities and be able to answer your question. Worse comes to worse, contact your state Attorney General's office.

It's impossible to give an accurate answer without knowing what state you're in. That said, an unloaded gun in a locked case that's inside another bag wouldn't be considered "concealed" in the vast majority of states, and a cop would have no reason/justification for searching your cousin's bag unless he were suspected of committing some crime.

Is he that good with a handgun? Also in Texas, most drivers are "strapped" too.

The following applies ONLY to me. YMMV greatly.

I live in Virginia, I have a Concealed Handgun Permit. I can carry my 9mm Glock anywhere on my person or my bike concealed without a problem. In any state that recognises my VA permit, I may carry concealed on my person. Carrying the pistol concealed on my bike would vary state by state. Since Virginia is also an open carry state, I could my handgun in a holster in open view in Virginia.

The problem comes when one is biking on any kind of trail/park system. Each state has it's own regulations regarding where a weapon may be carried, and there the Federal regulations to worry about.

Without knowing what state the OP lives in, anything else is pure speculation.
