Points on your Dr Lic from Cycling Tickets!

Just got several emails from our bike club sec'y RE: Cycling tickets. These were messages from members about the subject. At least here in FLA, and I suspect many or most other states, a cycling ticket can result in points on your Dr. Lic and affect your auto insurance!


"Another one of our club members (who shall remain nameless) received a traffic ticket last weekend for going through a red light at a T intersection. It's a $230 ticket and points against your driver's license."


"Just out of curiosity called my insurance company.... Just to see what happens if you get a ticket while riding a bicycle. They laughed a little then checked with the underwriter...she was amazed to find out your insurance will go up as if your were driving a car.... "

"in (Germany) DUI on a bike results in loss of your (car) driver's licence."

Huge problem in Boulder right now. There's a lot of tension b/w the cyclists and motorists. Two very popular rides (Hygiene and Jamestown) are regularly patrolled by the cops to enforce cyclists coming to a full stop at the stop signs. A lot of tickets are handed out and the occasional arrest when the cyclist gives a false name or has a warrant.

On the bright side, in Colorado, traffic citations while on a bike are not assessed against your DL.

Your club's wrong. If this actually happened to anybody then the judge who did it is wrong and the bike rider who got the ticket should spend 5 minutes googling before going to court. This is right from the Florida regs:

Points are not assigned to the driver license of a
person who committed a violation while driving a
bicycle. Points apply only to motor vehicle operation
[§322.27(3)(i)].

I haven't found a state yet that didn't have similar language in the code. Insurance probably just goes off points so that becomes a null issue.

also I have notice on the road to Jamestown or Ward car like to run over cyclists sometime too.....I was backpacking that area...saw few truck trying run over cyclists..... and had nice talk with some of the local and the battle in that area too.... I know that Santa Barbara area the enforce some a lot those laws like DUI running red lights...and few years around Huntington beach and Newport you were require to carry a bike lic.

Perhaps someone who knows for sure could chime in, but here in FL I think the Insurance guys go by violation, not points ... but could be wrong (frequently happens )

Don't know about the insurance issue, but the law is clear that you get no points in Florida for a violation on a bike. If you get a ticket, you need to make sure the officer notes on the ticket that you were on a bike. If you pay it, you need to make sure the clerk notes that it's a bike ticket. If you fight it, the judge needs to know it's a bike ticket.
