What shocks me the most is:

"NO VALID DRIVERS LICENSE" and "HOLD FOR IMMIGRATION" he is either illegall in this country or maybe on a tourist visa. Just Incredible.......insane......

I'm somewhat surpised his bond is only $31,000, particularly considering he fled from the scene, and resisted arrest. Both would indicate that he's a flight risk.

However, the last two lines indicate that the Magistrate still has to set the final bond before he's released, so it could be upped.

Looking at the driver's picture, I have to say I have sympathy and prayers for him as well. Here's a relatively young person who has royally screwed up his life. He will likely suffer signifcant criminal punishment that will follow him for a long time, and will always have to live with what he's done.

By no means am I suggesting that he does not deserve severe punishment, or minimizing the consequences of what he did. Just saying it is a tragedy for all involved.

Perhaps if more people understood that they are risking much more than a "simple" DUI when the choose to drink and drive, fewer people would do it.

He looks like a ******bag who belongs on Jersey Shore. I hope he rots in jail, just like Marco Valencia, the 20 year old 3-time DUI driver who killed a local club rider in my area last July.

He appears to be a minor celebrity, plays acoustic guitars. There are interviews of him on YouTube. Interesting that the arrest report says he resisted officers.

The "No vaid driver's license" entry is odd, but no big deal. If his license had been suspended for something, the entry would say "Driving whiel license suspended," whihc in FL is dfferent than no valid DL. His license might have expired or something like that.

The immigration hold only means that he is not a citizen and immigration needs to determine his status. From the looks of his web page (which is now down), I suspect he is a legal immigrant.

His website had interesting tidbits about his life. He skiied with the Argentine ski team, he was a skydiver, and, interestingly, it said "Carlos' driving record IS NOT clean."

Leaving the scene of an accident involving death is a first-degree felony punishable by up to 30 years. DUI manslaughter is also a first-degree felony. Under the sentencing guidelines, the minimum sentence (that's with no prior record or other sentencing factor) works out to around 11.5 years. Miami has a bit of a reputation of allowing celebrities to by their way out of DUI crimes. Donte Stallworth, the Cleveland Browns receiver, last year killed a guy while driving drunk and got a couple of months in jail and house arrest, and paid an undisclosed settlement to the victim's family. I doubt Carlos has that level of celebrity. Stallworth also stopped and tried to help the victim, and otherwise cooperated fully.

He is being held at the PTDC (Pre-Trial Detention Center). Due to today's holiday he will most likely appear in front of the Magistrate some time tomorrow. I have been trying to find out who the judge will be and maybe we can send him enough e-mails or call Captain Linda Edwards (PTDC Supervisor) to make sure they know that we "cyclist" care for our lost colleagues, no matter where we live or ride.

First appearances are held every day, regardless of holidays. By the end of the day today his bond status will change. Because of the seriousness of the charge, my bet is that he will stay in jail until he gets a bond hearing before the circuit judge assigned to that case, probably in a week or so. But it is Miami, after all, and he could be sleeping at home in his own bed tonight.

He's 28, he should know better but I understand what you are saying, many people think it's only their life they will screw up and not someone else's

Bond is now 100,000.00. I have mixed feelings about this...

On one hand I hope that they crucify him as a deterrent to those that act so immaturely and selfishly. But the cynic inside tells me it won't make a difference. People won't pay any regard, continue to have "just a few more", and convince themselves that it won't happen to them and and in case it does the precedent of other DUI cases speaks volumes of the so called punishments. Leaving texting and driving out, no doubt this ****bag has heard of DUI penalties, the risks, and the horrors it causes. Therefore making an example is certainly warranted.

On the other hand, that could be any one. Clearly the decision to drink is a voluntary one and complete responsibility lies with yourself. But I am saddened that this person was not surrounded by friends or a support system that would have stopped him from taking the actions he took.

I am sure they can handle a few "crazy" Idiots, after all they are every where nowadays. As to the people with influence I don't see them doing much about it nor riding a bicycle to truly understand the problem and to find a solution which must start with EDUCATION & RESPECT for bicycles!!!!!!

I myself have been hit twice by cars RIDING ON THE BIKE LANE.

However, BF is not the place to post this guy's FB or MySpace. The link to his booking is in this thread (several times) and if you can log onto BF you can log onto those sites as well.

Step back and give it a moment's thought and I'm sure you'll realize why BF doesn't want to facilitate the sort of stuff that is probably getting sent to this guy.

I made this a public reply instead of a PM as more than one person is interested.

I can understand being mad. I'm mad but BF isn't the vehicle to express your outrage directly to this guy.
