    I'm sure it's because I read and commented on this thread yesterday, but I got 2 cars on my short (12km) commute to work today. First car was parked, and I head the ping of the rock hitting it as I passed (I did feel a little bd about that one, but didn't hang around to see if it left a mark). Second car was 5 blocks later - they were over taking me as we rounded a corner. Rock was really loud when it hit, but the driver didn't seem to even notice.

    Look at it this way. If his car had kicked up the rock and it struck you in the eye, would he have stopped to see if you were ok?

    For you to be liable, you have to be neglient, i.e. breach a duty of care. You did nothing wrong here.

    This is a road hazard, and the reason people have "comprehensive" coverage on their vehicles.

    Does remind me of a funny occurence in a crtierium here in Jacksonville. Course was dowtown, with the second corner right in front of a store with a big plate glass window. Somebody hit a rock as we went around the turn, shooting the rock into the window and shattering it. Happened a bit behind me, and I just heard a hell of a noise.

    I thought someone had gone up on the sidewalk and into the window, only learned it was just a rock a few laps later.
