In California, cars are supposed to merge into the bike lane by turning right. Other states are different. There's a difference of opinion about which standard is better, but those who favor California's standard argue that it helps prevent right hooks. Not that 99% of the drivers on the road know or care what the standard actually is.
Oregon Revised Statute 811.050 Failure to yield to rider on bicycle lane; penalty.
(1) A person commits the offense of failure of a motor vehicle operator to yield to a rider on a bicycle lane if the person is operating a motor vehicle and the person does not yield the right of way to a person operating a bicycle, electric assisted bicycle, electric personal assistive mobility device, moped, motor assisted scooter or motorized wheelchair upon a bicycle lane .
(2) This section does not require a person operating a moped to yield the right of way to a bicycle or a motor assisted scooter if the moped is operated on a bicycle lane in the manner permitted under ORS 811 .440 .
(3) The offense described in this section, failure of a motor vehicle operator to yield to a rider on a bicycle lane, is a Class B traffic violation

My first thought too. Then when I learned it was a bike lane, my first thought was how the whole design of this thing is a set up for an accident. Sure the driver was careless, I'm not defending him... but the road design made it easy for a little bit of his carelessness to cause a big problem.

Dear OP: how fast do you think you were going at the time of impact? I am curious how fast you need to be going for a bike to be crumpled up like that. Hope you feel better soon!

You don't have to be going fast when the front wheel of a Lexus RX300 lands on top of your bike's front wheel (I was traveling under the speed limit of 35mph 20-25mph before hitting the brakes then the car)
Due to some kind of snafu the PIP is being held up, and my ortho doc won't schedule an appointment unless their certain that they are going to be paid. I've not had medical attention since the crash (outside of the school providing some bandages and re-wrapping the splint. Part of the problem is that they are calling and leaving messages at my home, instead of using my cell... And yes, I'm now talking to my attorney.
