No, again to clarify, I don't believe in criminalizing drivers due to insufficient conditions, etc. But the drivers in general need to be reminded that they need to take more responsibility for the speed they are going in conditions that make it too dangerous to do so.
The driver is in control of the conditions because he/she created those conditions by how fast they are driving in them. The person in front of them has no control over the condition other than being "in the way", because they are using the road (which they are supposed to have the right to use). All the person in the road can do is keep watch for the motor vehicles coming up behind, and hope their lights are enough to light up Broadway so the driver notices them, and if not, be able to bail off the road in time to not get hit.
If the driver cannot see ahead sufficiently, they should adjust their speed accordingly. Too many drivers have been observed going way too fast for those conditions because they've only been lucky so far that a 1500 lb bull moose didn't step into the road just out of their line of sight.
