I think $10 million is over the top, seeing as he told the police that he was only slightly injured. I think he should go for the amount Cafferty paid for his Cadillac + lawyer's fees.

I hope he gets what he deserves, and nothing more.
If he was "weaving in and out of traffic" as so many curriers do, he should be lucky to have his life. If this guy is going for an attention grabbing case hoping to hit the big payday and he suffers a loss, we all look like fools.

he paid his fine and did community service.

Hey if a jury gave some woman 2.9 million for spilling coffee
on herself (in a moving car) they can give the cyclist what

punitive damages is determined by several factors including the income of the accused... the courts will determine how much punitive damages to be paid depending on the severity of the tort and get a sorta percentage of income as punishment... meaning that you can get more from someone earning $1 million a year than someone earning $50,000 a year... a $50,000 fine for the million dollar guy is just mere pocket change... while a $50,000 fine for the guy earning $50,000 means no eating for one year... and even if the driver already admits fault, the cyclist still needs to prove that his injuries/losses/damages/emotional distress is worth $10 million... and that's considering the driver is earning considerably more than $10 million... tort cases like these rarely goes anywhere...
