That picture breaks my heart. How about if we all email that picture to Governor Perry's office and ask him if he still thinks cyclists are adequately protected under existing law now that two parents are dead and the driver is facing no charges.

That would be premature. According to the article, an investigation is ongoing and the DA has yet to determine whether to charge the driver with involuntary manslaughter. All TX cyclists will be watching the outcome of this one, for sure.

This has been a tough month for Texas cyclists.
First Larry McQuien in Fort Worth, then this couple, and then on Saturday Todd Martin died on a club ride. No details yet on what caused his death, but he was NOT hit my a negligent driver.

I'd like to hear what you think would have "protected" the cyclists.
EDIT: On second thought, maybe you simply mean vengeance/payback... which is still entirely possible, and depending on further investigation, hopeful.

I heard of this story when I first saw the title posted on BF but I never read any more about it. Today I figured I'll read some but I never got round to it. I just saw that first picture at the top of this page. Their little daughter. And tears started.
They can do what they need to do the driver. It wont change a thing for Kylie. Something drastic needs to change.

Actually, I don't see anything that could've avoided this. Either the person was truly out of control... after swerving for some reason, or simply wasn't paying attention which led to the swerving... either way, nothing short of a concrete barrier could've prevented it.
I'd like to hear what you think would have "protected" the cyclists.

The problem we have right now in Texas is that people don't pat any attention to us...and if they bump us, run us off the road, or even mow us down and kill us, there are no consequences. If you have somebody you really hate in Texas, teach them to ride a bike, then mow them down with your car and tell the cop it was an accident. You will never spend a day in jail. People won't start paying attention to cyclists and won't give us room unless there are laws that provide consequences for failing to do so.
And FWIW, I don't want "vengeance" or "payback". If it was truly an accident, then the guy is probably really torn up over it. But if he had accidently swerved into another car on the road and killed somebody, he would pay a price for it and would likely do jail time (or at least get probation), regardless of how upset he was about it. The only reason he isn't already charged with something is because it was a cyclist he killed instead of another driver.

Sickening, Im on this road 2-3 times a week. NOT AN ACCIDENT, A CRASH; SOMEONE NEEDS TO BE HELD ACCOUNTABLE AND LIABLE.
