Frame Damage

So i thought you guys would be the best to bring this to...
I have an aluminum frame which i got for free but the headtube is slightly dented where the top part of the headset goes in. Is there anyway you guys could figure to fix this?
By the way the picture makes it look worse than it is the dent is only probably 1-2 mm

is this ok?

I have a brand new allez with less than 5 miles on it. I noticed this notch in the rear dropout the other day. Its painted over so it came out of the factory that way. Does anyone know if this is ok to ride?

I would definitely return it. Any mechanical manipulation of aluminum will definitely weaken it at the molecular level, making it much more suspectible to stress fractures, fatigue failur, etc.
