Screw that, can you sue in America over "Morals"?
I don't think it's the photographers JOB to warn people about hazards. Sure, the photographer took advantage of a situation. I see dangerous stuff all the time, I don't point it out to everyone I think it could affect.
What about all the other cyclists that hit that same pothole? Did they go and warn people about it? Sue the bastards!
I can understand people being pissed, but I think it's about morals.
Edit: Oh, sorry. "criticised". Yeah, I see no problem with criticizing it. But I also don't think the photographer did anything wrong.

I would have a hard time not beating him to death with his camera once I woke up if that was me on the bike.
