Actually, the excuse was the phone, the reason is totally unclear, other than extreme negligence and zero concern for anyone else on the road in any manner at all.

I hope they DO file charges. A clear case of manslaughter - negligent homicide. I commute across Tampa Bay two days a week, on the Gandy Bridge. It is 3.25 miles across the bay and it is straight as an arrow. The speed limit is 55 and I have a ten foot wide shoulder on which to ride, so it is safe enough - as long as the cars STAY IN THEIR LANE. I watched in horror one day as a car, after passing me, about a quarter mile up the road, just wandered out of his lane and into the emergency lane, with the dust and debris you normall find in the emergency lane flying out from under his car, and then he wandered back over into his lane. Makes me wonder how long I can keep doing this commute until I end up like Mr. Serrano.

One has to wonder when investigative procedure into accidents these days will incorporate checking cell phones at the scene of the 'accident' for most recent activity and become mandatory just as checking for alcohol in the bloodstream is now.
Technology which makes our lives easier seems to make us deadlier, as well. Odd that.
