The cyclist did nothing illegal. The trucker was engaging in a redneck cultural ritual called "rolling coal". The trucker was making threatening actions toward the cyclist, and the cyclist is being charged for using words?!?!?!?

You don't need to remove the cat to "roll coal". All you need is a diesel engine and to soft pedal so that soot accumulates in the cat, then floor it and it'll blow the soot out.

There are limits, the most famous being the Supreme Court ruling that you can't yell "fire" in a crowded theatre. And personally, I am disappointed that the cyclist even exchanged angry words with the idiots in that truck. Just let the authorities handle the matter once you have the proof of their idiocy.

Did he instigate though? Doesn't appear so. Whatever, I'm sure he was startled, frightened... you have to give a little leeway. And I didn't hear 10% of what I would have been shouting at that jacka$$.

Actually if what you are saying is a threat, there could be a problem. But, say that the 160 lb guy on an 18 lb bike is "threatening" a pair of 200 lb rednecks in a 6000 lb truck. The problem with citing the cyclist for threatening speech in that case is one of credibility.

The cyclists' F-bomb isn't what the Sheriff is using to cite the cyclist. In another article, the investigating officer says the department "suspects" that he must have said "rude, disparaging comments" that were not captured in the video.

Of course, this presents all sorts of problems for the DA/Sheriff as well. Probably even moreso than if they just relied on the video evidence.

Yes, it's a clear case of "I have solid video evidence of an assault on a public road" vs. "I bet that guy said something"

I didn't realize this before reading the article you linked but apparently he was riding with a buddy, so that it won't be his word vs two d-bags in a pickup. You'd think they could at least give the littering passenger a citation.
