Update: As usual, still no criminal charges as the civil wrongful death suit gets filed. Also as usual, the defense argument is: I did nothing wrong and I'm a good person who meant no harm... but without any explanation as to why the motorist was unable to keep their vehicle in the traffic lane and/or take actions that would have allowed him to yield sufficient clearance to safely pass the cyclists.

This story still crosses my mind from time to time. I wonder how that little girl is doing today?

That is so sad I'm tired of these drivers killing people and walking away. I'm starting to think the world just does not give a $;& about cyclist or there family's. This guy should of clearly been charged from what I read.

I wasn't familiar with this tragedy, but it appears that in the interval after this thread went dormant in 2009, the driver was charged with criminally negligent homicide and was found to be not guilty by a jury in 2012. (see tandemgeek's link above)

This sort of verdict is one of the reasons I left Texas after a very short stay. I just couldn't live in a place that was still living in the '50s in oh-so-many ways. Reading about the defense claim that since many people have incompetently "drifted" out of their lanes while driving there shouldn't be any consequences for those who do it in a deadly way really reminded me of the pre-MADD days when drunks staggered away from the deaths they caused without any consequences.
