    Hit and run in Hawaii, big island

    March 3, '07 hit by large pick-up truck and knocked out. Lots of injuries, coma 6 days, 2 weeks ICU. Police officer did not charge driver he said I fell and had road rash. Helmet crushed in rear but no body damage to rear, back or shoulders. Could not damage helmet by striking ground and not hit back unless LINDA BLAIR,

    Police refuse to issue report and sight Hawaii Privacy Laws, only redacted report telling me who I am.
    Help.

    There is a bigger audience in the regular A&S forum. I would post this there instead since this is not directly linked to vehicular cycling.

    CBHI, any input?

    Is Hawaii a 'no fault' state? are drivers required to have PIP coverage? What's up with this rider being unable to glean info from the authorities?

    is your state that hostile towards bicyclists that they are prevented in attempts at recovering damages in traffic incidents because of 'privacy laws?'

    what gives, CB?

    CB Hawaii has posted continuously on the unfriendliness of his state towards cyclists.

    Are you just now getting this? What gives, Mr. Bekologist?

    Carrying Bike Lane Wars to the extreme?

    I thought you were a friend to cyclists everywhere....? (I guess capitalizing on tragedy goes on all around.)

    WOAH, lil' bigg.

    i'm asking legitimate questions.... is or isn't Hawaii a no fault state? does Hawaii have mandated or optional PIP insurance coverage? why would a cyclist injured in a collision with a vehicle be unable to contact the drivers' insurance company?

    your attempt at smearing me is lousy, lil big man. CBHI is the most active hawaii poster to the A&S forum. I'm not picking sides, dude - there is no 'war' in my post.

    Just got back from work on the Big Island, so tonight is the first chance to read the thread.

    Hawaii is a no fault state and requires motorist to carry insurance. More important, state law requires motor insurance to cover personal injury to a pedestrian or cyclist, regardless of fault. Property damage depends on who was at fault.

    As to privacy laws prohibiting the release of a traffic accident report, that is pure BS. Most likely a case of a Hawaii County Police Officer, from a small town knowing the motorist and feeding such BS to the cyclist to try and protect the driver. People involved in a traffic accident are not required to call the police unless there is bodily injury or property damage greater than $3000. They are required to exchange identification and insurance information if police are not called. If 911 cannot be reached, and there is personal injury to a cyclist, the motorist is required to transport the cyclist to medical care. When police are called to a traffic accident, they are required to record ID and insurance information to be included in the police report. Both parties are allowed to get a copy of that report in full without any court order.

    To the OP, don’t put up with the BS. Demand a copy of the full report and record names of any police or county clerk that give you any BS. Then get a lawyer and take action against the county and the motorist.

    We have our share of "Bubba Cops" here, as well as the good cops.

    Accident

    Thanks for your input, it helps. Police officer Smith apparently accepted the motorist version of events. As I was unconcious I could not add my side of events and was unable to get any info. Since my head cleared a little I've found the 3rd car to arrive with college students who saw that I was not breathing and restored my air way. People in first two cars were just watching me laying on ground not taking in air. Reported by students they gave differing stories male in first vehicle said I was just laying along the side of the road, female said she saw me fall. Third person gave another verson. Student belive they were lying. Students gave tag number to paramedics, don't know if they gave number to police.

    Have contacted Wm. Lawson attorney from Hawaii and asked him for help. Thanks,

    LBM - I gotta side with Beck on this one. I don't see any hostility towards CB HI on his part. It reads like a genuine attempt to get some legit info from CB HI, and he seems to be ready to accept its veracity.
