What could he press charges against the cops for? False arrest? This would be a civil violation, so there are no charges to be pressed. His remedy would be via civil lawsuit claiming his 4th Amendment right to be free from an unreasonable seizure was violated. Good luck proving that when a cooperative witness is pointing him out saying he's the suspect.
