From the article: "McNair is expected to recover from his injuries, but is family said that is likely to take months." Good news. Still... how can they *NOT* cite driver for hitting a cyclist? I can see if he made some kind of move to go into an adjacent traffic lane and the motorist couldn't react, but if the motorist simply misjudged the distance, they should be charged at the very least with an unsafe pass or something. In Fort Worth, there would be a violation of the 3 foot passing law which was passed a year or two ago.
