I would hardly call putting out the fire after your house has burned significantly as being "on top of it". Same goes for firing your manager after he threatens a witness. In my world its more like "being way fackin behind it."

If it was a criminal trial you'd be right. As its merely an administrative hearing for disciplinary procedures in a sport then the full protections of court laws do not apply here. Having said that, this is just too weird and is just sad.

I think with time people will look at Greg Lemond as a courageous whistle-blower; a guy fighting for the integrity of his sport and willing to make enemies in the process.
Of course right now he's being tar and feathered -- its the price you pay for not respecting the cycling omerta.

I can agree that he may be viewed like a "courageous whistle-blower" but I think that will be incorrect because i dont think his true motives are in regards to the integrity of the sport.

The one thing that sort of sticks out about his whistle-blowing is that he's claiming Lance must've doped to win the tour, Landis did it, and yet his 3 TdF victories (against cheaters) were great races where he remained pure as the driven snow. The only way he'll really become a courageous whistle-blower is if he admits to hitting the juice himself.

Without that, even if he WAS clean, everyone else will be trying to smear him on their way down.

Witness tampering is not limited to criminal proceedings. 18 USCS Section 1512 makes it a crime to to intimidate or threaten a person to prevent or alter their testimony at an official proceeding. 18 USCS 1515(a) makes clear that "official proceeding is not limited to criminal trials.

Official proceedings do include proceedings before Federal Agencies authorized by law. One might make the argument that a arbiration proceeding under the USADA, an agency authorized by Federal Statute meets that definition, however it would be a stretch.


Regardless, even if witness tampering in this arbitration is not a federal crime, it is nonetheless sanctionable conduct, and the Arbitrators have a wide range of options in dealing with it.

The Arbitrators can draw an inference from the incident adverse to Landis;

The Arbitrators can bar Landis from presenting witnesses;

The Arbitrators can even strike Landis' defense.

How the Panel responds is within their discretion.

At a minimum the incident has turned the testimony of old, bitter ex champion with an axe to grind from mere sour grapes into a serious problem from Landis.

An Arbitrator can now easily conclude there is in fact something to Lemond's testimony given Landis' agent's efforts to deep six it.

yeah he kind of reminds me of jose canseco if canseco never claimed to have juiced in the first place.
