Iowa law apparently (not firsthand knowledge, but inferred from some of the articles on the case) has specific language that covers causing death when texting while driving. If the crime is defined specifically, that would trump the more general manslaughter laws.

The victim's family could sue for civil charges since the perp has already been determined to be guilty. A federal court could also press charges, considering it's manslaughter in any definition, and is therefore not exempt from higher courts. She may be guilty of texting while driving, but charges still could be pushed on the wrongful death, correct? They're two separate things, from a judicial point of view.
