Cut the baloney. The Driver is a ******

I can't believe some of you are defending this guy.

Look at this interview with him EDITORIAL: Watch the road, respect cyclists and pedestrians

He first claims he thought someone threw a bike at him. Then he claims he never knew he hit someone. Then he goes onto to say he would never leave someone who needed help.

He should go to jail.

If driving a car is that miserable for you, maybe you should get a better car.

I love riding. I like driving a car. Both are fun. Both have their uses.

My choice of transportation activities is almost entirely based on how much time I have. I'd love to ride every day to work but it's a 50 mile round trip. When it was 20 miles I rode most days, but I can't afford 3 hours out of every day for transport, so I drive most days. It's NOT "miserable" though it's not as much fun as riding. Still relatively enjoyable.

The two abreast argument is specious in almost all cases, unless the road is very wide.

it's made by people in cars who want to (unsafely) squeeze past a cyclist who they think should be hugging the gutter. Even if the cyclist is on the white line, if the car gives the recommended (if not required) 3 or 4 feet, few roads in the country would allow that without the car crossing the center line.

Given that the car is going to cross the center line anyway, it can't pass until the way is clear. If the way is clear, then fully changing lanes is not a problem anyway.

So why on a narrow road is riding two abreast a problem?

I have noted that car drivers these days seem to have a serious aversion to turning the wheel more than a few degrees. I'm serious about this. I have noted that when pulling into or out of the subdivision I live in (I have the corner lot) people tend to go very wide, driving in the oncoming lane for a couple hundred feet or more, unless there's oncoming traffic there. And they like to cut the corner, driving on my lawn a lot (do I sound old?). When passing people want to just barely turn the wheel.

I don't think you can make a cage nice enough for me to like it. I never was much of a car guy. I view them as a necessary evil. I can appreciate a nice automobile. I enjoy the classic cars. My car is fine for me;most modern cars are. But knowing myself, if I bought a better car, it would own me instead of the other way around.

People here are very lazy particularly on left turns where they routinely make a 45 deg entrance to side streets cutting any vehicle coming out of the side street very closely. Then they give you a dirty look as in "how dare you be right where you are supposed to be in your own lane stopped at the light or stop sign". They also seem to have an expectation that cars turning off the road they are on will somehow make their turn on only 2 wheels at a high rate of speed because they allow no margin of error and make no allowance for the car that's turning to vacate the space that they are entering.

It does not matter who or what is in the road or for what reason. This person hit someone directly in front of them on a clear and bright day and there is just no excuse. Throw the book at this miserable fook who has no impulse control or patience or compassion for a fellow human being.

I haven't noticed anyone defending the driver.
He hit and left claiming he didn't notice the human bouncing over his bumper which would excuse his leaving since the bike was perhaps "thrown at him" so he did notice the bike.
No one on earth actually believes the " someone threw bike at my SUV"
Yes he should go to jail but he won't.

So no real news.

I'm sure that nothing short of a long prison sentence will satisfy some folks here.

However, one of the beauties of charges like these is that no matter the final disposition, there'll be some punishment in the form of a very large legal bill for the defense.

WHOOOO-
The Feds never seem to undercharge-
and guessing those charges are meant to scare him into a plea
Geez I wonder what the worst penalty "assault with deadly weapon" can bring-
Years right?

And he must be a piece of work-
his own SON ratted him out-went out of his way to tell the cops it was his dad!
Very bad sign when blood relatives-your own children-are actively helping the cops to arrest you.

And what in the world does the below mean-"found unconscious on the floor"-
seems to imply drunk/drugged??
Hmmm he might not have the $$$ to buy his way to a no jail outcome.

Officers reportedly found Neely unconscious on the floor of his home. After he was woken up, Neely said the bicyclist threw his bicycle at him, according to the indictment.

His son rats out the old man. His place of employment immediately puts him on leave. Sounds like they all know this guy has a problem, and this isn't the first time.
Probably drunk *******

"found Neely unconscious on the floor of his home"
Wow-that sort of precision-sounds like they broke in found him passed out on the floor
Drunk or heavily drugged is clearly what the cops are suggesting
and the son making an effort to rat him out-obviously he hates his father
not dislike as in "you treated mom badly" actual hate
He might be heading to jail

Does anyone here have any idea who his lawyer is??
Does he have some high priced connected lawyer?
Or just a "find the cheapest lawyer in phone book" talent?
The FEDS have nearly unlimited resources-when they want to get you-they don't worry much about expenses
Now the charges-guessing he could weasel out of the last two-"lying to LEO and destruction of evidence"
But they charged him with intentionally hitting the rider
funny no mention of the HIT AND RUN aspect?? State type crime maybe??

Does he have a famous high priced lawyer??
Or just a lawyer?

Lying to Federal officer is a lot more serious than lying to local LEO.....
Wouldn't taking those stickers off his car mean that he knew he hit the biker?

And ... well, there goes the Volvo drivers image...could make a good car commercial

It was previously reported that his son has avoided him for years because he is an abusive drunk.

Thanks- that explains
1)son ratting him out
2) found unconscious on floor
3) intentional aspect of it-mean drunk is a mean drunk-usually mean sober too

He better have Clarence Darrow.

Geez-maybe he will claim he was too drunk to intentionally lie-and too drunk to lie

The sticker removal-yeah why would he do that-coincidence tough sell

Maybe Volvo can use this to suggest their SUVs are soooo soundproof and so ruggedly built-you won't notice riders shrieking while bouncing off your fenders

The reality is that suspects lie to federal officials all the time, and it's very rarely charged because it's expected that suspects will lie.

Martha Stewart's case was different because she wasn't lying as a suspect, but as a witness in order to hinder prosecution.

So, in this case, the lying to officials charge isn't likely to be sustained as the case proceeds, but is being used as a lever to get a plea on the core charges.

The problem with lying to police or Feds isn't that you'll be charged and prosecuted for it. It's that if the case were to come to trial, the lie would be brought out to undermine your credibility as a witness in your defense.

It looks like they are going to make an example out of him. If so, then they are also making a general statement about something, maybe about supporting bicycle use.

OTOH - it might be as simple as saying that assaults won't be tolerated, which is as it should be.
