The cyclist is at fault for running the red light.

The driver is at fault for not stopping (which is illegal).

One personís illegal act does make anotherís illegal act legal.

So if you run a stop sign and I hit you with my car, it's ok for me to leave you at the side of the road to die?

No, the hit and run statute has nothing to do with fault. You really want people to judge their own cases and determine whether they need to stop or not?

Even without any "bullies", family "cars" are bigger than ever (pickup trucks, SUVs, etc.), roads aren't any wider, and humans are highly imperfect in many ways. Even if every motorist was as polite as Mr. Rogers, accidents will happen and cyclists will always be the losers. How to avoid getting hozed? Ain't but one way: Stop playing in traffic.

Running red lights is standard practice for most cyclists...but most of them are also smart enough to slow down and even stop to look and make sure that the way is clear before going through the red...not like the moron in the video who just blows through the red, causes and accident and gets an innocent driver in trouble.

What part of failure to perform the duties of a driver do people not understand? The bicyclist appears to have caused the incident by failure to obey a traffic signal. The driver of the car did a runner.

One is a traffic law violation. The other is a criminal act. You don't have to be a JD to know which is which.

I get to see driver's blowing through stop signs frequently and it seems to me that most of them just seem to not notice it was a controlled intersection. You just never know anymore Bad idea to expect animals to do what they ought to when riding a bicycle.

This is a little old news, but it's the first I've seen this issue being addressed by the Governor of NJ.

Gov. Murphy says DeGise hit-and-run is behavior that's unacceptable, doesn't call for resignation.

Seriously, this thread is a really good example of what's wrong with A&S.
Obviously, any bicyclist who goes through an intersection blindly on a red light is going to be at fault for getting hit by cross traffic that is proceeding on a green light. There could be some contributory fault if the driver was speeding excessively, which will foreseeably make the consequences of any collision worse, but there's really no evidence that that's the case here.

Just as obviously, there is a statutory duty to stop after hitting someone, regardless of fault. It is wrong to violate this law. Up until this thread, I have never heard anyone seriously question whether there should be such a law, and whether we have the option of ignoring it if we don't think it's fair because it wasn't our fault.

In other words, the legal and moral answers to the issues in this are completely mundane and obvious.
For some reason, people seem to want to have a "hot take" to discuss even if they have to ascribe arguments to other people that they are not making, or they need to adopt crazy takes on the law that I really don't think they'd be espousing if they were hit or they hit someone..

Amy DeGise struck a bicyclist with her car and drove away. She might get away with it.

An especially crazy feature of Jersey City Councilwoman Amy DeGiseís hit-and-run scandal is the commitment by her fellow Hudson County Democrats to pretend it never happened. And as the saga stretches into its 3rd week, Ms. DeGiseís constituents are learning about her track record of treating municipal and county government like itís her own private candy store.

Just to review: DeGiseís SUV struck a bicyclist at an intersection on July 19. The cyclist, an Uber Eats driver who apparently ran a red light, was not seriously injured in the spectacular-looking crash which was captured on CCTV.

Ms. DeGise is charged with leaving the scene of an accident and for not reporting the mishap to police until six hours later when she apparently bumped her head, thus jarring her memory of the crash.

Sounds crazy right?

We subsequently learned that Ms. DeGise had at least a dozen unpaid ticket, mostly in Jersey City, all of which were paid the same day they came to light. So it was never about the money for Ms. DeGise who makes nearly $200,000 a year working multiple taxpayer-funded jobs.

She has a history of skipping out on financial responsibilities.

The Jersey Journal reported on Aug. 3 that DeGise lives at the College Towers apartment complex near New Jersey City University. The complex is intended for low-to-moderate income families, but DeGise was reported to have nearly $200,000 in yearly income.

$105,000 of it came from working at the Hudson County Schools of Technology, and $85,000 came from her job as a councilwoman.

The report continued that she also paid $290,000 for a house on Seaview Avenue in the city in 2020. Her spokesman told the Journal that she and her fiancť had bought the house with plans to move into it, but was delayed due to renovations since 2020.

The Journal also reported that she was ordered by a Hudson County court order to pay a nearly $3,000 veterinarian bill at the Oradell Animal Hospital in Paramus, who won a default judgment against her earlier this year.

DeGise then said via her spokesman that she was unaware of legal action until the school district told her that the court ordered her wages to be garnished to pay the bill and an additional $500 in court fees.

Other reports have also revealed that she attempted to dispute her vehicle from being towed in Hoboken last November after having parked in an illegal spot and her vehicle registration having expired, as well as having not paid numerous parking tickets.

...it took a couple of years for that South Dakota Atty General guy to finally be removed from office, for hitting some pedestrian on the highway, and leaving him to die in a ditch. But it did happen.

That was a pretty clean hit. Car mostly hit the bike, not the person. Bike was lucky.

This thread is insane. It's been summarized multiple times by people with a little bit of sense.

1. Horrible riding. Ran a red light. Should get a ticket. (Traffic offense)
2. Apparent criminal act leaving the scene of an accident. (Criminal Code) Even the "I'm afraid I'm going to get mugged" - the response is to stop, call emergency services and stay in your car if you're that petrified.
3. Investigation by news outlets - seems a pattern of this politician not believing in cause & effect or fulfilling responsibilities (paying bills, tickets, etc.)

Other than the possibility of the driver getting away with the hit & run offense from connections, there's not much to discuss. The cyclist was 100% in the wrong for the crash, and while the driver could have been driving slower, there was not sufficient reaction time to do anything even at a lower reasonable speed. Doesn't really look like she was even speeding as a possible contributing factor to the collision .
