Second Canadian to suggest that. While I understand that Canadian laws are perhaps not quite the same as U.S. laws, I can hardly believe that assault and battery are not criminal or civil offenses there. Assault and battery using a weapon? Most likely a felony. Definitely a criminal and civil offense, weapon or not. It transforms the innocent cyclist into the guilty felon in the blink of an eye, and suddenly it's the cyclist who is being prosecuted, and the driver who is state's witness (and later, the driver who is collecting the damages from the cyclist.). Attacking the vehicle instead of the driver (probably what you're suggesting here)? Still a criminal and civil offense, still a potential felony.

assault and battery are offenses here in Canada, I never suggested hitting the driver, I said his windsheild would be just as good. I don't think that is assault or battery. I think it just standing up for your rights as a cyclist not to have to get killed whenever you are out riding. What about the idiot who tries to kill someone in a car? He/ She will probabaly get a slap on the wrist even if we do get his/her plate number.

Actually, I was being too lazy to look up the law to see what attacking the car would be in California, so I made some general statements about assault and battery, and leaving attacking the car as an unanswered question. dchiefransom cleared it up with an outcome that I didn't even expect.

I have a friend who broke out all the lights and a couple of windows of a driver who hit him and drove off. The caught the driver of the car as a result of the damage and his insurance covered damage to the bike, but my friend had to pay for the damage to the car and attend anger managment classes. It ended up costing him more than just fixing the bike but I think it would be worth it.
Look at it this way, if they never find the guy at least you ****ed up his car. If they do, at least the guy gets a hit and run on his record even if you have to pay for damaging his vehicle.

So at what point, when getting nailed by a car, does it become attempted murder do you think?
If someone hits me intentionally, I'm not going to worry about their car or what I may do it. I do generally leave my u-lock at the office so I'm not tempted to club someone about the head and shoulders with it. I can shatter the sideview mirrors with my fingers, if I need to make a forceful point. Back in the day of messing I did take all the glass out of a car that almost wiped me off this plane of existence though... not a proud moment but you shoulda seen the frats boys faces as I was doin' it. They didn't seem it was as funny as when they ran me into the front of a street cleaner at the corner.

If one is under genuine attack from a roadraging motorist the bicyclist should be concentrating on evading the deadly vehicle, not "fighting" it with a silly 2-pound lock.

When under attack it would seem the motorist is generally trying to push you into something stationary, or off the road rather than leave your mark or your bike's paint on their car. I've seen them want to get out of the car and fight..... silly motorists. "Dude ....do not get out of the car or I will be forced to hurt you...."
Just be sure to leave your finger prints all over the roof in a defensive position for ID later on.

If someone get's out of their car and approaches me with the intesnt to injure me, I will introduce my U-lock to his face before he injures me. I am simply defending myself IMO.
