Police say passenger threw bottle at cop

A Bogart man threw a soda bottle from the back seat of a car Tuesday night, nearly hitting a University of Georgia police officer who was patrolling South Hull Street on bicycle, UGA police said.

The man and the driver, an Athens resident, were arrested after officers stopped the car on Pulaski Street, according to police.

Carey Daniel Hardaway, 19, threw a bottle of Sprite at the officer for no apparent reason, just missing the officer's head, police said. Hardaway, of 170 Yorkshire Road, Bogart, was charged with simple assault, police said.

The driver, 19-year-old Vincent Green of 395 Bob Holman Road, was charged with being party to a crime, obstruction of a law enforcement officer, possession of marijuana and reckless driving, police said.

Yes, by all means, if you're going to be assaulting a police officer, be sure to first stock up on your in-car stash of marijuana.

Damn! What is it with people in Bogart? A few months ago, there was an incident there where a car pulled out in front of a motorcycle resulting in the motorcycle following the car to their home, which resulted in the father of the driver shooting the motorcyclist in the back, killing him. I'm staying away from Bogart.

A cop doesn't even get hit with a bottle and all kinds of suffering and serious charges for the bottle thrower and driver.

You or me get beaned by a bottle thrown from a car, report it... and nothing.

The critical difference is the cop witnessed this assault. You or I get beaned by a bottle thrown from a car, a cop sees it and does nothing, or you or I get beaned by a bottle, a witness corroborates our complaint, and the cops do nothing, THEN it's time to raise hell..

Right. My word means nothing to a cop. A cop's word means everything. Would it help if I was a Notary or Justice of the Peace? A town official who swears in on the same oath as a cop? I'm glad the offenders got caught, but still hate the double-standard--you or I are obviously not as honest as a cop.

It's because the 4th Amendment requires "probable cause" for an arrest, and under state law, "probable cause" typically means that the officer witnessed the offense. It can also mean that there's some other type of evidence that the offense occurred, and which indicates that the suspect is the one who committed the offense.

We may not like it when our word isn't taken at face value, but think about the kind of society we'd be living in if somebody could be sentenced to jail, or worse, whenever another person makes an uncorroborated accusation.

Right, and according to that statute, you can make a citizen's arrest on that person. That's not the same thing as calling the police and telling them to go out and arrest somebody just because you say you saw them commit an offense. And even in a citizen's arrest, I think you'd still need some corroborating testimony to support a conviction...Unless you think there's some special reason the jury should believe you when the other guy is denying he committed the offense.

I'm dying from the knowledge that there's a town called Bogart, GA. Is it just before you hit Munchies, GA.? Is it a municipality in Toke County?
