Got chained by a car, then the occupants tried to assault me

Yesterday, I was riding home from campus, and from behind, i catch a 1" chain ot the back from a passenger in a car. 50' further up the road, the lgiht turns red and these 3 guys hope out of the car and come after me. it's 5:20 on a VERY busy road, and im ducking behind cars to keep a vehicle between me and these guys the whole time. they finally take fof, but the police siad it was my fault for not riding on the sidewalk. They plan a bike lane on this road, but dont have it in the budget to paint until like 2012. What course of action can i take to increase it. mind you, 9 cyclists passed in the 10 minute window i talked to the police, and in teh 41 days ive been riding this stretch of road, ive been egged, hit by 2 cans, threatened by a DHL driver, and clipped by an Expedition. They re-did the road many years ago, and left room for a bike lane, they just wont paint it. Should I go to city hall?

You got "chain-whipped" by a passenger in a motor vehicle? That's something new, I never heard of that happening before.

I think the cop was wrong. He should do his job and take down a description of the car and it's occupants.
Hitting someione with a steel chain is a felony assault. IIRC.

You said you've only been riding this route for 41 days. You seem to have listed a number of surprises encountered in that short span of time.

I think you need a rear view mirror. You need a mirror to warn you what's coming up behind you.

IANAL, but . . .

First step is to arm yourself with knowledge of the laws regarding bicycles and their use on the road. The League of American Bicyclists have a great resource of state laws. Second, document everything, incidents (including dates and times), license plate numbers, names, who said what, etc. If there is assault, get evidence (photographs, doctor's reports, etc.) and if there are witnesses, get names and numbers. This way, if lawyers need to be involved, you'll have a body of evidence to support your case.

huh? something is rotten in the state of Denmark...

this whole post seems highly implausible. Where in the world did this incident occur? If you got chain whipped from behind by a car you would have marks- and the police ignored this incident?

this is too weird... should you go to City Hall about the bike lane? how about going to your local newspaper or better yet, the New York Times, about the lack of police enforcement in your area.

Unless this whole thing is made up...

A stripe marking a bike lane will do little to resolve the kind of problems described. But, if you feel that its needed, look around and see if there is an cycling advocacy group that will take up the cause. If not, go to city council meetings and request council authorize the lane. Organize your own group and begin lobbying for the lane. As its apparently near a college campus and students use the road to commute, get the college behind you in requesting the lane. Or, find another route.

I'd have found another route after the first incident. Sounds like someone's a glutton for punishment.

I know if I were chain whipped from behind on a very busy road I would probably fall. Then I would be easy prey when my assailants exited their vehicle to continue their assault.

In other words, I don't believe this post either.

+1 to this.

Busy road at rush hour, 3 people hopping out at a red light after already having assaulted the guy, ducking around cars, and the police fault the guy being chased? C'mon... no one else on this "VERY busy road" had a cell phone and called the cops?

I worked as a courier for 2 years in downtown Cleveland in the early 90s and didn't have as much stuff happen to me as this guy claims happened in just over a month.

I was skeptical of the OP at first as well. But read the link in apricissimus' post, which describes a very similar incident.

If this happened to me, I would be on the phone with the office of the police chief or police commissioner of the jurisdiction demanding to know why his department was refusing to investigate a violent crime. Then I would make similar calls to the mayor, the DA, and the newspapers.

Me too. Posted by Rev.Chuck whom I recall as being a more level headed poster here. At least more level headed than myself.

So as what to do, I don't know. With all that happening I'm wondering if there is something "personal" between Otto and some individuals out there. I'd change routes or try to get a "buddy" to follow with a camera to document. I think a typical rage thing happens once and the people involved rarely see each other again. If all these incidents involve the same people then it's a big problem. It's almost like a stalking thing. If so, I'd change routes, my appearance, clothes and even my bike.

If this is a reference to this same incident, and this actually happened, then the priority for this community is not bike lanes or striping but responsible law enforcement.

I would get names of any witnesses, go to the local newspaper and the mayor's office and file a complaint against the police officers for their lack of action in response to an assault.

Otto, my apologies if I am incredulous and you really were a victim of such an attack it's just unbelievable that your community both in terms of policing and your fellow citizens is so lacking.

Bicycle camera.

Do you think the NYC cop would have been stripped of his badge & gun unless someone got his assault on film? Absolutely not.

I got a old reflector mount, 87 cents worth of 1/4"-20 hardware, and my old digital camera & mounted it on my handlebars. I'm taking it out for it's first run today & can't wait to see how it goes.

If the incident is true, than I am not surprised at the lack of participation from potential witnesses. It is all too easy to [I]not[I/] get involved, mostly from the fear of being sued by someone. The parable of The Good Samaritan is still very much a truism, even in our so-called enlightened age.

This is literally unbelievable. In my entire LIFE of riding, many years on city streets and highways, I haven't been actually assaulted once, let alone so many serious assaults in 41 days on the same road. I've been harassed, sure, but chain whipped, chased, hit by cans, threatened, clipped - none of that.

my mind was blown. it was, and this sounds like im making it up, 3 black in all black t shirts. i wrote a letter to the editor of the Raleigh newspaper, and actually had a voicemail from a local news station asking me to participate in a story they are running about police apathy towards cyclist complaints. i usually cut through a park and niegjhborhoods, but it takes about 20 minutes for the main road to clear to cross, so if i go one road up, i can go over the bridge. this road isn't THAT narrow, so it was completely unnecessary. prior to being hit, i got a warning honk though, accompanied by "****** mother****er!" cause i ride a purple biek i guess. i'm 6'6" and this was fight or flight for me. the parking lot got it on their security camera, hopefully i can get a copy. googlemap oberlin rd wade avenue raleigh nc usa and you;'ll see where it occured. i wouldnt make this up, i had such rage in me, and fear. im scared of retaliation. they're gonna get US one by one? im literally ernvous to ride main roads at all now. the silver topped building with the blacktop parking lot has it on tape. thats where they pulled in adn stoppped. i ran into the building (white square) across teh street. bnehind it you can see teh park i usually cut through

when i got hit (they hit my back, i had a bag on), i yelled "F*** you!" as anyone would. i guess thats what prompted them to stop
