Car driver only charged with DWI so far:

https://blogs.villagevoice.com/runnin..._merkel_up.php
Merkel was arrested shortly after leaving the scene of the wreck. She was booked into jail on charges of DWI and released -- which is when she invited those upset that her stupidity led to the death of an innocent mother of two to "suck a ---- and choke on it."

seems like she should at least be charged with leaving the scene if not hit and run

What a sweet, lovely, misunderstood woman, NOT. If she was so innocent, why did she flee the scene? If she was so innocent, why was she drunk at 0745hrs?

As I said before, both her and her boyfriend need to be sterilized so that they can't have kids. And they need to down a very LONG time as a guest of the state. As well as having their driving PRIVILEGE revoked for life.

The family of the deceased should also file a wrongful death suit against her, her boyfriend, her friends in the car and whoever sold them their alcohol.

Dear God. My worst nightmare is to take someone else's life with my actions, irresponsible or otherwise. I doubt my ability to continue on with my own life if I robbed someone else of theirs. Two kids will grow up without a mother because of her and her boyfriend...that anyone could respond with such callousness... This woman is not deserving of life.

These accidents are tragic and too frequent. You never know where or when. Enjoy riding but it is and has always been a dangerous way to get around.

Really? I think that people get pretty upset under either one.

Recently an ex-Vikings player's wife ran over and killed a guy (probably DUI but not proven because she ran and hid) and she got absolutely destroyed in the public arena.

They still let this idiot keep his drivers' license? How many more people does he have to kill, before his license is revoked!!!!

I believe the article said that he never got a license in the first place...

This one certainly says so, anyway:

A spokesman for the New York State Department of Motor Vehicles tells 13WHAM News that Megan Merkel and Mark Scerbo II never had a valid driver licenses in this state. Scerbo surrendered a learner’s permit he had in 2007.

it's odd that by accidentally stabbing someone, a pedestrian would serve X # of years incarcerated for the offense.
but if a moto(cyclist)rist accidentally stabs a pedestrian or cyclist with a car the penalty is often half that of the other (same) crime.
I don't think there's anything accidental about what these creeps were up to, if it turns out they were on their cells at the time, i would seek murder one. this guy was a master at one wheeled jerk riding, i'm not buying 'oops'.

I'm sorry, but I have to disagree with you. Bicycle riding is NOT a "dangerous" way to get around. It's stood the test of time, in that it's been around LONG before the automobile, and will be around LONG after the automobile is history.

Now, yes, the actions that some take on their bike are dangerous, but bike riding in and of itself is NOT and NEVER has been "dangerous."

I only listened for a few minutes -- I just don't really care about her story. I'll bet the prosecutor is interested, however.

Man, I'll bet her lawyer is upset with her ...

For whatever reason the link doesn't seems to work from within the mobile app. Maybe if it were a tinyurl it would work.

He's her boyfriend, shouldn't she know if he had a license or not?

Question, was he totally released from jail/prison, or was he on parole? If he was on parole, shouldn't this incident violate his terms and conditions of parole?

I can see where his just being out of jail/prison is relevant, but how is her marital status and/or having kids out of wedlock relevant? I agree with you that they are probably try to "paint" themselves as "victims" in this, which we all know isn't true.

so, as tragic as this incident is, the suggestion of suing "the friends in the car and whoever sold them the alcohol" is equally idiotic. what do passengers in the car have to do with it ? and if the alcohol was legally sold, how in the world is the vendor responsible for later acts ?

your 'sue everybody' litigious attitude is one we could use less of.
