Carlos Bertonatti update

The latest as of 8-18-2012, is another dumb hearing on 10-22-2012. His lawyer is really dragging this out.

Gee, here in OR when a motorist kills a cyclist they just ask the DA to reduce the charges and it is nearly automatic. Here's a local example: https://www.registerguard.com/rg/news...mbley.html.csp

This excuse of a human just mowed a woman down, then he went on to a convenience store to get some refreshment before coming back to watch people attempt to save her life. It's at least his third wreck in the past few years and at least the second one in which he made no attempt to avoid the collision. Sentence: six months in county jail, which actually means six months of weekend litter crew since we have no beds left in the jail. Additionally, he'll be driving without a license or insurance in the future.

After a monumental effort by our local cycling community, one of our local motorist was sentenced to 12 months in the county jail for their extremely poor driving habits that resulted in the death of a cyclist. The DA was initially going to go for a plea bargain that would have had the motorist spending only a few days in jail at the most, which only angered the local cycling community into action.

B. Carfree, you wouldn't believe some of the stuff that happens to bicyclists around here. The college kids (specifically the fraternity boys) seem to really have it in for cyclists. Getting buzzed is just the beginning. Imagine being followed for blocks being yelled at, taunted, having things thrown at you. It's pathetic. Cops will take a report but not much else. The college is the backbone of our local economy and it wouldn't do to piss off the kids holding the money that makes this town work. The sad thing is this is an amazing town to ride a bicycle in. We have a path that connects us to the nearest 2 towns, bike lanes galore, low speed limits, locals give you plenty of room when they pass, a large and active bicycle advocacy group, 4 bike clubs, 2 bike shops, and a exceptionally bike friendly local government. Also we have a stop as yield law and a red light as stop sign law. Truly a great bicycling community. Bike racks all over town are full nearly year round. The more the city adds the more they fill up. Yet some ******** from out of town have the need to disrupt life in our quiet little town.

On a bicycle you don't have to stop at a stop sign, if it's clear go on through. You have to stop at a red light but if it's safe you can go on through without waiting for a green light.

Basically, it's patterned after the Idaho bicycle stop law.

I believe it *is* the Idaho bicycle stop law. (iheartbacon lives in Idaho or is talking about Idaho, yes?)

I don't think any other states have adopted it (yet?)

... Unless you're in Idaho, where STOP doesn't always mean stop. And so far, it has not been a recipe for disaster -- it's worked out just fine.

I'm part of the official pilot program for this law in California. Works great and saves a lot of time!

Not only works fine, when it was first implemented, it produced a reduction in cyclist involved collision at intersections. Cyclist were already through the intersection before what would have been left hooks, right hooks and hit from behinds.

It's worked fine for me, and I don't ride in states that have that law. I stop or slow as appropriate for the road/visibility situation and other traffic, not for inanimate signs.

Ah, so you are conducting the pilot program for your area -- what state are you in?

wow. Common sense. If bicyclists can make it work, it's a great law.
