Ultegra Crankset

I need to replace my Ultegra 9sp triple crank set and I am having a difficult time locating one. There are plenty of deals on the 10sp triples at the LBS(I do want to buy this through my LBS)and I know they can order a 9sp for me but at a higher cost. Does it really mater with the crank set whether it is a 9 or 10sp? it seems to me the only place that would be an issue is in the rear cassette.

IMO a modern Tiagra 9sp crankset is an upgrade from a legacy (i.e. Octalink) Ultegra crankset. Newer technology and construction have trickled down to make 9sp Tiagra a nice performer at a good price if you're not hung up on the name.

No. The 10 will work fine. BTW, I'm surprised that your LBS did not tell you this.
