Hmmmm, a felony to steal a bike, good idea. With today's prices and older bikes with collector value, it's no longer just stealing a 'bicycle'.

Ha! This happened in my neck of the woods...The Bridgestone belongs to the fine young man who runs the "Boise Bike Project" (the local bike co-op) was stolen from the bike rack in front of the bike shop! The theft was made known via Facebook to nearly a thousand "friends", and was found very soon there after. Happy ending!

If the guy is getting unfairly charged w/ Grand Theft, I tend to side w/ the guys that are saying "This guy is getting to be a PITA, let's see if we can do something about him....."

I would think his defense attorney could make a case that the thief had no way of knowing a thirty year old steel ten speed was worth more than $500. Are bike thieves expected to stay on top of the UJB vintage bike market so he can distinguish the bikes with cult followings and those without.
The lawyer could present the jury with a bike rack filled with 1980's bikes and ask them to pick out the collector bike versus the ordinary ones.
On the other hand if the thief tried to sell it on ebay with a high reserve, 25 close up photos and two pages of flowery Petersenesque prose it might indicate he knew he was committing grand theft.

His intent or knowledge really doesn't matter...though I'd certainly challenge the value of the item. They're over charging for the plea deal I'd wager.

Since the guy was stealing bikes off a rack, I think he'll get a public defender. Hopefully he will end up w/ the dumbest, laziest public defender in Idaho.
