The New York State Assembly votes to legalize eBikes, nearly every year, often UNANIMOUSLY!
Then, is killed every year in the Senate.
12 year history of Assembly passage and Senate rejection. - See -NYS eBike History

Up for consideration again this year.

As someone who rode bikes all through childhood only to graduate to motor vehicles like every other adult in society the primary reason I got back into biking recently was due to my interest in exploring the capabilities of electric bikes. My personal experience in western NY has been that ebike use is basically not enforced by local police, either because my setup has a reasonable degree of stealth and/or I ride it like a regular bike (i.e. Always pedaling and traveling at 'believable' speeds) and/or they just don't care and have more important things to do than harass 'bikers'. What I find most hilarious is that police, even if they do decide to stop and ticket you have nothing to charge you with that makes any sense. Since they are literally undefined under current law (are not motorcycles, mopeds, scooters, etc) supposedly they've been writing up tickets for operating an unregistered motor vehicle, which is odd since the NY DMV explicitly states that bikes lack the necessary equipment to be eligible for registration. That ebikes currently find themselves in legal limbo and the fact that half of the state government nearly unanimously believes they are 'bikes' and has voted as such for over a decade may be further reason for the lack of enforcement. Basically, if you're holding off on riding an electric bike because of their 'illegal' status, you might as well pull the trigger, because no one seems to care. I've had multiple cop cars drive right by me without a second glance while I was biking in the shoulder on public roadways. As long as you look like an ordinary cyclist and ride like one, you basically ARE one regardless of what bike you happen to be riding.

I'll have to second kaplooi comment. The police don't want to waste their time with bicycle riders. Make sure though you don't give the rest of us riders a bad name. Follow the rules of the road and wear the proper safety gear. Then there is absolutely no reason for police to have any contact with you. We need to police are own because the only people that can hurt our reputation is ourselves.

eBikes Legalized in New York State
 
Governor, finally, got sick and tired of congresses' near 20 year ineptitude and executive ordered electric bikes and scooters into legality.
750w, 20mph limit.
.
"The following are essential laws to be aware of when riding an electric bike:
  • The rider must be over the age of 16
  • The rider must ride on either the bike lane or the street
  • The motor of an electric bike can’t exceed 750w.
  • The speed limit is 20 mph
  • Not permitted on roads with speed limits over 30 mph
  • Rider must wear a helmet if their e-bike can go over 20 mph, or they are under 18"
20mph limit scooters legal, with same restrictions.
