Are you asking if it is legal to take the property of another without permission? Just want to be sure I understand the OP's question.

So, she's a "therpist" because she flunked out of law school?

I would even bet there's a clue on the crate. Does it say "Property of <Some Milk Company>" on it?

Most of those crates are marked "Misuse liable to prosecution." That is not unambiguous...

Use of the crate to transport anything but milk/dairy product, by the clearly labeled business which owns the crate...? Just a guess...

But to your point, any use which doesn't involve one of them strapped to the back of either a bicycle or motorcycle is definitely at least egregious mis-utilization of them...

I was recently at a store that had 6 packs of 20oz Pepsi on sale. They were packed in the blue plastic trays 4/tray and I picked up 2 trays and took them to the register. The cashier scanned my drinks, I paid for them and carried them to the truck. Would that have been stealing? True story, I have no use for the trays, have meant to take them back so they could get rid of them or rotate them back to Pepsi but so far I still have them.

Ask the milk delivery guy if you can take the crates. Don't be offended by the answer.

Is it illegal to take a car that was left outside in the open? Yes
But other people take cars and nobody charges them! Still illegal.

Hopes that clarifies.

Oh this humor is a good way to start the day. A newbie posting a nonsense question, designed to troll but getting some great responses. Plot foiled again

This "therpist" would it happen to be a sex therapist and by that I mean someone you find on a street corner and pay for certain acts.

If the milk crates are 'obviously' (it's not obvious what 'obviously' means) left as trash (like piled up on/next to a dumpster), then I'd say fine. Otherwise no.

HOWEVER, a long time ago when I lived in England, I grew a nice collection of English pint glasses by picking them up from outside the front of pubs in the mornings. I don't regret it.
