My avatar is gone, for another reason my sig, we will leave the reasons to PM...

If your avatar, sig, handle, etc are simular to someone elses but you make no conotation that you are the other person is that violating copyright?

I.e. if I choose a cow or termite avatar would I be violating copyright for having them?



I do not mean for this to bring out what was said in the PMs out... what remains in PM stays in PM

My avatar was created by a friend from scratch....it was designed to be similar to another picture, but it is different enough that I'm not worried about copyright infringement. I used the logo from the following website for a long time because a friend had sent me the pic. I had no idea it was a logo for a company until a year or so later.

Some are, some aren't.

Some people here probably use their own personal photography or artwork in their avs and sigs, in which case they are.

It happens...i got a mod smackdown a while ago in a computer forum for using a quote that the maker of didn't like me using, and it got ninja edited on me, and I was locked from changing my sig for a week. Given the quote's meaning was changed in a very wrong and disturbing way when separated from the rest of it...but that was the humor of it.

I think that's where it lays...that you might have put those up in humor, but another saw it as mockery or otherwise. Pretty much, when doing pardoy, expect to occasionally step on a toe or two...that's why I don't do much parody here, a forum for certain things...I have SPF forums to create drama in.

EDIT: oh, and for my Avatars, I usually edit the image enough that few would complain. I have used copyrighted stuff (like heads from the penny arcade online comics, the winged buffalo logo that belongs to BW3, and many many pictures of ficuses...whatever that counts for), but I made sure to be very subtle in my usage of them. Pretty much, if it's obscure, or is found on t-shirts...I'll probably use it.

You've had a few avatars in the last year as have a few others. Some avatars come from the avatar menu and I have noticed some copies from time to time however I have to say that the painted toe nails IS a custom avatar that's strongly associated with someone else who had it first. Probably wasn't the best idea to do something simmilar.

I think this is deeper than painted nails, but I can not verify that. If I put the bug back in my avatar and someone then put a bug in theirs I would not care......

I guess you could call it "brand" recognition but even then if no conatations were made that I was something else then...

I personally don't care, someone could have been a little nicer about the whole thing... could it be I just post about 100x more than the other individual?

i highly doubt the person's avatar to which your previous avatar was similar would have been offended. that person probably would have been flattered (judging from that person's history of good-natured and fun posting).

We are fortunate to be able to have our own avatars on this forum. As you may know, other forums make us choose from a fixed pallet of avatars. Others have none at all.

As far as copyright...you took the photo of your feet, right? It's yours to use as you wish. Just because it vaugely resembles someone elses is no reason for it to be hijacked, IMO.

Look as how close satirists can come to copying their targets, and still don't get in trouble.

I sure hope my "sharrow" avatar isn't copyrighted...or the governor or California will beat me up!

As a graphic artist and former professional photographer, I can tell you that you did NOT violate anyone's copyright. Just as eubi stated, you took the photograph, therefore YOU own the copyright on that image. Its resemblance to someone else's does not constitute copyright infringement.

BTW-Mine is copyrighted, because I designed it from two PD icons
