I need to move

I need to move. My neighbor has taken to drinking in front of his unit. We all live in a townhouse building, so he can't be more than 20 feet away. The front of the homes aren't really designed for any kind of sitting out front, just a small concrete pad in front of your door, and a small grassy area in front of that.

The neighbor (I refer to him as pea brain), pea brain does not work. He sponges off of his girlfriend (the town house belongs to her) . He has purchased a bench and placed it out front. They have a perfectly good deck in the back but he would not be seen by the other neighbors in the back. So I think he gets lonely during the day. Sit out front on the bench, hoping for a neighbor to come home from work and entice them over with a can of beer so they can talk. The other day I had near 20 people sanding in front of my unit drinking. These parties occur 3 or 4 times a week with varying number of people. Besides it not looking good to potential buyers in the area, the next worse part is no freaking privacy.


The building next to me has a number of lame brains too. The other day a number of them were all sitting out front, grill going on the sidewalk, lighting fireworks out over one of the other buildings. The #1 lame brain in the end unit will sit out on his pad and drink and he and pea brain will shout at one another back and forth. I am right in the middle of them.

This is not a run down neighborhood. It is probably lower middle class to middle class people living here with a few bad apples. The property is kept up very nice by our management company, lots of green space, lots of trees etc. The buildings are kept up very nicely. They are probably more than 30 years old and still look great.

And before someone says I should join them. First I don't have the time to stand outside and drink. I get home from work, go for a ride or work out, come home make dinner, answer some emails and see what's on the forum, maybe a little TV, then off to bed. Second no way would I engage in a behavior that is sure to bring down property values. It just is not good to have people standing out in front of the building drinking all of the time. But most of all pea brain would never have me over. Years ago, he had his grill pushed up against the building. Our second floor over hangs the first so the smoke was going inside my unit. I pointed that out but also the fact that it was very dangerous. Pea brain responded "I don't know how that could happen" (referring the smoke). That made me angry and had it out with him. Later I apologized for getting upset. He would not take the apology and has not spoken to me since.

So I decieded that before things get too bad around here, turns into a low income housing and my property value plummets I am getting out. The only issue is everything is so freaking expensive around here.

If you are referring to my situation. I am doing something about it or at least trying. I am working with the board to see what can be done and talking to some of the other long term residents, making them aware of the situation. They are not happy either. They realize that while my building might be removed from theirs, aberrant behavior in one building will affect the property values of others.

But what are they doing? Seems like they're not doing much seeing you're thinking of moving. You ever call the Police? Ever tell them to move their party some place else?

The board? There is not much they can do. I did make the suggestion that the management company speak to some of the more reasonable participants of the party and explain that this type of behavior is not only rude to other neighbors but they are damaging their own resale value. Many of them are young and don't realize what they are doing. Pea brain is supposed to be 50 and I can't figure what a 50 yo would have in common with a 20 yo but then again he is a pea brain. Don't know if they can do anything about pea brain, he basically right to sit out front and drink has a but if others refuse to join in on his parties, maybe he will stop sitting out front.

But we still has lame brain in the next building. I am thinking he is a renter and we have been able to work with owners before to get them to evict problem tenants.

I would check your CC&R's to see if any violations are going on. If not, then you're pretty much SOL unless you can convince the HOA board that the behavior is affecting property values.

My neighbors and I were able to get rid of the renters from hell in our neighborhood who had the police searching their cars every other week. We called the police for any suspicious activity and documented it to the HOA. The owner ended up selling the house and a nice young family moved in.

That is the issue. He is not breaking any of the rules. They do keep quiet so that can't be used against him. I suppose the board can enact a rule that says you can't drink in front of your home but I doubt that could stand.

Pea Brain next door is a freeloader. He sponges off of his GF. The GF owns the place and buys into is crap so not too much that can be done there. But lame brain up the street might live in a rental unit. We have successfully worked with problem tenants before to give them the boot.

The only issue is that she knows he is too fat and lazy to go out and get any women. Plus she knows he does not have any money to "rent" one.

I'm the president of our HOA, and we get complaints like this from time to time. There isn't much that can be done if they aren't breaking any rules, and often the ones that complain are doing the same things they're complaining about.

One thing we did do that might help you is to put up some security cameras. If you put one up that's aimed at your property in a way that records pea brain and his friends it may get them to move to the back. Especially if you're really obvious when you install it.

I am the former president of our board. I have been on and off the board for a majority of 20 years and I do not recall ever having to deal with a situation such as this. The vast majority of our residents have always been respectful of their neighbors, About the worst we have had to deal with for owners is getting them to clean up after their dog.

That is not to say we have not had some really nasty situations. We have had criminal activity but it has always been from either a tenant or residents of one of the two county owned units that rent to low income folks. We have always been able to work with the owners and or the county to give problem tenants the boot.

Go over and ask for a beer, drink it real fast and ask for another one. After awhile he will decide that when he drinks in front of the house someone comes over and drinks all of his beer and he will go to the back yard. Or else you'll get a lot of free beer. Win-win either way.

Well he would never ask me over because he can't stand me. See I used to be on the board and he does not think he should have to follow any rules so he hates all of the board members.

The board in our community has always been extremely flexible. No where near as strict as most boards. Real simple. Keep you place up outside, follow a few simple architecture guidelines and clean up your dog's poop. I hate rules too but I understand that in order for people to live together in such close proximity there needs to be some rules.

Yep, this is a well-known technique in malls and other public places to keep the vandals at bay. It doesn't have to be loud, but enough to be heard across the way. So long as there are no rules against some outside music. Combine it with the security cameras (because you've had some "security issues" njot related to pea brain), and you may be on a winner. Subtle but effective.
