You are on the public highway, when pulled over, do the whole roadside song and dance routine, perfect, great .

Do you know if the DMV can suspend your license for refusing a breathalyzer while riding?

Thanks but for reference I'm pretty good with finding links. I'm kind of asking for someone who knows or has experience with the question.

not a Lawyer . I cant quote the statutes. look them up.

Anecdote incident a year ago,
they pulled me over , saying my wheel was turning a lot,
none rode a bike

this was just what they were told to look for . so they had me do the song and dance ,
didnt win the prize .. cuffed me took me down town..

Not a clue to do anything with my bike Friday, couldnt lift it.

[ small wheels and going up hill at the time is why my wheel was turning

to keep the bike upright , wheel underneath you, ...which is the common Physics of riding a bike..

caught their Bored Memorial day weekend sunday night on drunk driving patrol, attention
+ the lights and the reflex ring on the tire sidewalls]

, but this was a Block from My apartment ,

so i said . "Put it in the front door. heres the key"..

then once in the sherrifs intake , they ran the breathtest thing

I was under the minimum , went to the court date , case was not prepared..
Jr Assistant DA was on holiday.

eventually they declined to file a case , dropped , but even though nothing legal was done ,
but Harassment,

to remove the stop itself from my record. there is a Fee .. ( i Haven't renewed my licence in A decade+ , nor owned a car)

but the mere act of stopping someone is recorded .. welcome to the bleak future..

I'm glad I have no children to leave to cope with what is Coming..

got $60 to throw in, for the processing Fee?

Zombie thread I know but still relevant. The answer in Illinois is YES they'll ticket for DUI on a bicycle. They'll also nail you if operating a riding mower while intoxicated or if you're just sitting in your car with the keys accessible. A guy in Coal Valley, IL. got nailed in his own garage several years ago. He had been putting a stereo in his car and had a few beers, fell asleep in the driver's seat listening to the new stereo with the key in the ignition. Cop drove by and saw him leaned back in the driver's seat, came back a little later and he hadn't moved so cop did a "wellness" check. Open container on the seat and alcohol on his breath, cop gave him a breathalyzer test which he failed. Cop gave him a DUI, open container ticket AND had his car towed out of his own garage! He tried to fight it, he got the container ticket dropped but not the DUI and had to pay for the tow even though the car had never left the garage all night until the cop had it towed. A coworker had a cop follow him the 3 blocks from the bar to his house and nail him for DUI and had his car towed out of his garage. In Illinois it's less about public safety and more about the money.

Last time I checked Minnesota specified motor vehicle for DUI. So you won't get one on a bicycle.

In Washington you cannot get a DUI on a bicycle. the police can impound your bike in the name of public safety. But beyond that all the can do is offer you assistance if they think you are too drunk to even walk.
