Is this still safe? Yakima Frontloader with Fenders

I've had the front fenders off our bikes for a few months now but have been wanting to put them back on. The reason I took them off was because when I bought Yakima Frontloader mounts I didn't think about fenders being an issue. Last night I was thinking about it and did a quick search and found on ORS Racks Direct that someone had the same question. Their response was that it works with most if not all fenders. So my question to that is what would the proper way of mounting the bike be? I took the fenders off because I didn't want our front fenders to be bent and riding the tire. For some reason I never noticed that I could adjust the mounting arm for the back of the front tire.

You can see how much of the wheel is being held in place, obviously a smaller arc than if the mounting arm was extended all the way out.

Up close you can see the mounting arm isn't pushing on the fender.

So you can see what is looks like on the mount. I can move the bike around and if I give it an upward jerk the front wheel will lift up a bit too. It seems to stabilized itself though. Just wondering what other people think that have experience with their bike racks.

Thanks!

On a second note, I will be sending them back to Yakima because there is a Recall on this model (bought in 2010). But the questions still remains of whether anyone thinks this is safe.
