Usually industrial parks dont care if your on the road that travels by the property and wont say anything until you actually enter their property. The road sign should state whether or not its a private way or not. But honestly it sounds as though one of the businesses has had theft or vandelism and has hired a P.I.. Or it could just be a rent a cop who's still bitter about being to dumb to be a real cop.

He doesnt have any 'authority' so theres nothing to 'question'.

He's just making you aware that your tresspassing, same as if there was a sign posted there. A sign can't 'do anything' to you either.

But if you are tresspassing you can get a citation and/or a tresspass warrant and he doesn't need anything more than a cell phone for that. Ultimately nothing still is going to happen to you other than not riding there anymore unless you resist the order for some odd reason. However I have a strange suspicion you might seem to be trying to get yourself arrested over this....not sure.

Obviously none of us here care either way but since you posted this here and are looking for opinions, my opinion is you might be a bit distrubed.

Why anyone would obsess and disrupt their personal life to this extent over a rent a cop sitting in a parked car is beyond me. I prefer to enjoy my rides and go home with good thoughts afterwards rather than seek out aggravation and a cause for personal vendetta. Not to mention that riding down to same old indutrial road to a chain link fence over and over again is not my idea of a preferable ride route either.

Weird.

Need a life? Listen to your wife!

And find some new routes to ride.

That is probably the most accurate description I have read

Not may places to ride around here without traffic. This is part of a 25 mile stretch I do every night, and this is my turn-around point the farthermost point out. I don't ride back and forth, just go to the end and turn around.

Absent any signs, I doubt a cop would actually cite you on first contact. I'd call his bluff.

I always try a peaceful solution. Engage the guy in conversation: "Hey man, I ride 25 miles everyday, my name is Gary. This is just a great place to turn around and there's not too much traffic. I will never go on your company's property, yada yada yada..." You might make a new friend.

Also as a veteran, get off my lawn and get over yourself. That hat is available at any Army-Navy store.

Most states also have allowances for shooting trespassers, regardless of how they feel about the rules.

I live on a private road, whether it's posted or not, they can't keep you off the road if any public money or utilities are used to maintain the road. If it's maintained by public services or money, than you have an implied right of way as a taxpayer.

A lot of private way residence around here had the way the option of accepting public services or paying for their own services in order to restrict access.

And, as Jon c. stated, the cops aren't going to do much on the first incident. Unless you have a record, they'll just escort yo0u off the property.

Would it be so hard then to just turn around 100' sooner.

sounds like for your personal mental health you need to go onto his company's property and "mark your territory" with some sort of bodily fluid or excreta. If that is indeed your long term goal, stop posting here now so the DA doesn't have evidence of pre-planning when you're eventually brought up on charges.

And then again, leaving DNA samples is not wise either.

I've been allowed access to some pretty great places that were "private" by not being a dick head and being a little bit friendly.

I did that with the first guy who said something. The second one was already in RAMBO mode when I stopped.

If it's just a place to ride through and turn around, what's the point? It probably really is private property, so why borrow trouble by picking a fight you'll probably lose?

No signs saying anything, other than ???? Industrial park. The road goes in front of the building, and at the end, there is a security gate with keyed card access (I never go there).

Many businesses back there. The business in question is fenced in, and they have their name on the fence, but that doesn't say they own the road in front! Was told by Skippy the security guard (they hate it when I call them Skippy, but again, no uniform, in his own car) I have been warned, he would have to call the cops.

I told him to please do!

So normally I ride up the road and turn around and come back. Today I did it 5 times, but still no cops., I'll try again tomorrow

Maybe I'm being a turd, but I have ridden this route for more than a year, and I feel I need more proof than some snot nose kid telling me I can't ride there. I told them to post a Private Property sign, and I will abide.
If you call your City where the property is located, they will tell you what the City code says about public property and private property in an Industrial zoned site. In my city, if its an industrial park, its all private property unless a city street goes through it (public easement). Be specific and cite the address of the industrial park.

No it is not--don't believe everything that you are told.

A verbal "warning" not sufficient. Need posted No Trespass signs.

Absolutely is.

We tresspass people off our property regularly. Lots of vagrants near our commercal units.

We tell them as such, they persist, we call the cops and the cops ask us what do we want to do.

You can tresspass people off your front yard, do you have signs posted there?

Thank you, I was just coming back to make the front yard point. I tell you to leave, you don't, the cops respond, and the level of the offense is higher because you have been warned. I would be surprised if that isn't true in every state in the union. Furriners may of course have different laws...

Same in my state; an oral warning is enough.

It can very well be private. Many years ago I worked at a closed US Steel plant. The private entrance road was a mile long before encountering the locked front gate. Many times we warned people that the road was private. Although from the main road it looked like any other small public country road, it was entirely on private property.

I find it interesting that so many folks are under the mistaken impression that their understanding of their local laws will be the same for a stanger who is not posting his location. Really! Check your state and local laws for the legal definition of trespass, then also contact the county or parish for land ownership. In some places there are no posting laws, in others there are. Being a good citizen and neighbor should lead you to learn the laws and respect the rights of others. Even if it is a private road it may not be trespass to use. In my state for trespass to be cited one must "enter and remain" both not just one of the above, however it does get more complicated than simply that.
