2012 Cannonade CAAD 10-4 Rival - Blue/Orange Rarity Question

Good evening gents -

I have a 2012 CAAD 10-4 Rival in the gorgeous blue/orange color scheme. I purchased it new and it literally has under 500 miles on it. Everything is stock.

A riding friend told me yesterday that Cannondale was sued for copyright infringement for that color scheme and pulled the bike before many were sold. He said it's very rare.

Well, I google-fu'd the heck out of it and can't find anything about it. Well, I found one post where one guy thought that his cousin said that Gulf Oil trademarked that color scheme and that COULD be the problem. So, you know, it's pretty official and everything.

At any rate - shot in the dark here - anybody know anything about this? My old body is breaking down and I'm thinking about taking my gorgeous CAAD and selling it so that my wife doesn't yell at me for having 6 bikes in the garage.

Copyright is for creative works, so the Gulf Oil racing colors can't be subject to copyright protection. However, I think they are protected by trademark law, which is something many companies do for specific color schemes that are associated with their brand. The key is anyone can use those colors (like UPS brown), unless it appears you're representing something associated with the trademark holder's brand (like another trucking or delivery service). So a racing bike from Cannondale that is painted in the Gulf Oil racing colors could probably run afoul of trademark law. However, I have no idea if this is something that Cannondale did with Gulf Oil's permission, or if your friend is correct and they got in trouble for it.

I bought the 2012 CAAD10 4 specifically because of those colors. They're beautiful bikes, and the colors are spectacular. And I wish your friend was correct, and that my bike, and yours, are really rare and valuable. But I don't think they are. I got my bike on sale from a large bike shop in Southern California that was having it's end of season sale (I think end of summer). All the Cannondales were discounted about 20%, so I got the CAAD10 4 for the price I'd been willing to pay for the CAAD10 5 a couple of months before, which was what I went into the store to buy. Several of that bike shop's outlets still had the 10-4s in the sizes I was interested in, so I got to try both the 56 cm and 58 cm. I didn't have any impression that they were having to send them back, or that they were doing me any favor to track down the size I wanted in their inventory. And they'd been offered at full retail through the spring and summer.

I've never seen another in the wild, and I see Cannondales everywhere (it's by far the most popular bike brand around here, and they were very common in Los Angeles/Pasadena), but there are so many models and years of Cannondales that I'm not too surprised. I also saw one for sale a little while ago, I think on eBay, and I don't recall that it commanded any special price. I think you have a really cool bike, but I don't think you have a winning lottery ticket. But here's hoping we're both sitting on gold mines! Or oil wells, as the case may be.

Rare maybe but not a collector's item (few bikes are). They pop up on ebay a lot. Two listed in recent sold auctions. One for $975 and other $950 with shipping

Just checked my records. I bought mine on Aug. 2, 2012, from Incycle in Pasadena.

I also tried to find any info online about this story. I found a mention on another forum (i.e., hearsay) that Cannondale wasn't able to sell them in Europe, because EU trademark law is broader than it is in the US.

Gents - thanks so much for the information. I too bought the 10-4 because of that specific paint scheme. Looks like a Formula 1 car to me and I seriously still love looking at it.

Looks like it's just another used CAAD 10, albeit a very beautiful one (subjectively speaking, of course)!

Sheesh....I was just looking at my profile and almost 10 years in this joint...time flies...

I have owned mine since new, January 2012, but the entire group is now Ultegra 6800, wheels are updated to Fulcrum Racing7 LG. I put over 20,000 miles in it before swapping out the group and wheelset. , It now has white Lizard Skin bar tape, and a white Prologo Scratch Ti rail saddle, all the cockpit components are still Cannondale C3.

No copyright problems I was ever aware of, they made a good many of this colourway, and had another model that picked it up a few years afterwards, too. As said above, you cannot copyright a color scheme, logos would be entirely different, though.

It is in interesting bike, lots of comments about the orange and blue when people see it on the road. mine is pretty well preserved, despite the mileage. I keep things cleaned up and it gets serviced regularly, looks much the same as the day it came home, first thing to be changed were the tires, 700X25 Gatorskins were put on in September 2012, and I have kept using them since, about 5000 miles per set is normal.

Edit: the bike in my sig pic is not the CAAD 10 4, that is a 1978 Medici Pro Strada.
