Old "surfer" motorist rages on cyclist -- "You're a dead man"

Notices
Road Cycling “It is by riding a bicycle that you learn the contours of a country best, since you have to sweat up the hills and coast down them. Thus you remember them as they actually are, while in a motor car only a high hill impresses you, and you have no such accurate remembrance of country you have driven through as you gain by riding a bicycle.” -- Ernest Hemingway

Yep, I think that's assault - threatening someone with serious bodily harm. Big, fat, and angry motorist vs. calm, short cyclist. Head butt, then take his car keys?

One: fundamental misunderstanding of how Stand Your Ground works; Two: CA does not have a Stand Your Ground law.

So what are you legally allowed to do if someone threatens to kill you?

So if the guy has indeed closed his business due to all the backlash from his antics, I'm thinking Chapter Two might read something like he waits in ambush to run over a large group of riders, then blows his brains out.

I think the cyclist was too vertically challenged (corroborated numerous times by statements to that effect from the motorist) for a head butt to be effective. He struck me as more of a knobby knee to the groin then judo chop to the back of the neck guy.

Legally, I'd imagine that your only option would be to report the threat to the police. I'm no lawyer, but I'd think that a mere threat (even if it was death) is no justification for assault. Now, if the surfer guy touched the cyclist in any way, he'd obviously be justified in defending himself, regardless of the surfer's age.

Just my opinion, but in today's litigious society, it is never a good idea to actually start a physical confrontation, regardless of the words exchanged.

Stand Your Ground says you don't have to retreat. It will not excuse throwing the first punch.

Immediate threat of physical harm is the bottom line for self defense. Duty to retreat or stand your ground, as the case may be, only apply when there is already a believable threat of imminent physical harm, I think.

T'were me, I'd have reacted the the same way this cyclist did. Notice at the outset he said "don't hit me" and didn't get touched...just verbally abused. It's hard to "walk away' from an in your face encounter like that while straddling one's bike. If, again me, this had turned into a serious physically violent attack things would have been handled differently.

Yeah, but the surfer dude wasn't just standing there passively stating a few non chalet statements, he was behaving in a threatening and intimidating manner. I think if the bike dude had behaved anything but immaculately (as he did) then the surfer dude would have attacked him.

I'm curious what happened to Mr Lewis. Did he ever get arrested or charged? It would be kind of amazing if he didn't. Watching that video again the literary of threats: killing, assault, homophobic slurs.
